The State of Alabama. Barbour County. Be it remembered that a writ of Capias-ad-res- pendendum, with endorsement thereon, was prosecuted and sued forth. Out of the Circuit Court of said County in words and figures and of the tenor following to wit: The State of Alabama

To any sheriff of the State of Alabama = Greeting: You are hereby commanded without delay to take Lewis J Leaird if to be found in your County and him safely keep so that you have his body before the Honorable the Judge of the Circuit Court of the Court to be held for Barbour County on the third Monday in October next. and then and there to answer Benjamin A Davis in a plea of trespass on the Case &c. to the damage of the said plaintiff of one million Dollars, and have you then and there this writ with your endorsement thereon - Witness Benjamin F Pethy Clerk of Our said Court at office this third day of July in the year of Our Lord One thousand eight hundred and forty eight, and of American Independence the seventy second year third 3d day of July 1848. B F Pethy Clk Cause of action = Malicios prosecution of the Plaintiff by the Defendant.] Buford & Pugh Plff attys. Recd. in office 6th July 1848 B. Williams Shff, Excecuted. 6th July 1848. B.
