Leland Stanford was the president of the Central Pacific Railroad.

The County of San Joaquin — vs — The Central Pacific Railroad Company et. al.

Be it remembered that on this 13th day of Dec= ember A. D. 1880., before me E. V. Joice, Notary Public, in and for the City and County of San Francisco duly commissioned and sworn Appeared A. A. Cohen Attorney for the plaintiff and S. W. Sanderson Esq. Attorney for the defendants and also came Leland Stanford a defendant in the above entitled action to be examined as a witness, by and on behalf of the plaintiff and was by me duly sworn and said examination was taken by question and answer as follows

A. A. Cohen Please state your name, age place of residence and occupation.

A. My name is Leland Standford, Age 56, residence City of San Francisco, occupation railroading and farming.

Q. 2 Are you the President of the Central Pacific Railroad Company, one of the defendants in this action?

A. Yessir.

Q. 3 Were you the President of the Central Pacific Railroad Company of California?

A. Yessir.

Q. 4 During what time?

A. Well during its existence.

Q. 5 Were you the President of the corporation known as the Western Pacific Railroad before the consolidation of that corporation with the San Francisco Bay Railroad Company?

A. I suppose I was.

Q. 6 When did you become the President of the Western Pacific Railroad Company?

A. I cant[can't] give you the exact time without referring to something. I suppose it was about 1867.

Q. 7 Were you the President of the San Francisco Bay Railroad Company?

A. I think I was.

Q. 8 Do you recollect whether you were the President during all the time of its existence or not?

A. I think I was.

Q. 9 Were you the President of the corporation known as the Western Pacific Railroad Company after the consolidation previously mentioned between the Western Pacific Railroad Company and the San Francisco Bay Railroad Company?

A. I think I was President of the Western Pacific Railroad Company as long as it had a separate existence until it was consolidated with other roads.

Q. 10 Were you the President of the cor= poration known are the Central Pacific Railroad Company during its

existence between June the 20 and August 22nd 1870?

A. Yessir.

Q. 11 Were you President of the California and Oregon Railroad Company?

A. Yessir.

Q. 12 Were you the President of the San Joaquin Valley Railroad Company?

A. Yessir I think I was President of that during its existence.

Q. 13 You were President of both the two last named companies during the existence of those companies were you not?

A. Yessir.

Q. 14 Were you one of the original subscribers to the stock of the Central Pacific Railroad Company of California?

A. I was.

Mr. Sanderson[underlined] I object to that testimony on the same ground as I objected to the testimony of Mr. Miller, upon the ground that the organization and con= struction of the road of the Central Pacific Railroad Company of California is not a proper subject of inquiry in this action and I advise Governor Stanford as his counsel to answer no question relating to the construction and organiza= tion of the Central Pacific Railroad Company of California for the reason that all the interest that the plaintiff in this suit has is confined to the Western Pacific Railroad Company prior to its consolidation with the Central

Mr. Cohen.[underlined]15 Your answer in this case sets forth that you subscribed to 150 shares of the stock of the Central Pacific Railroad Company of California. Was that stock issued to you?

Mr. Sanderson.[underlined] I advise you not to answer for the reason above stated.

A. Under the advice of counsel I decline to answer.

Mr. Cohen.[underlined] 16 If such stock namely 150 shares of the Central Pacific Railroad Company of California was issued to you will you state what value or consolidation you gave to the Central Pacific Railroad Company of California therefore?

Mr. Sanderson.[underlined] Same objection and same advice.

A. I decline for that same reason as before

Mr. Cohen[underlined] Q.17 In the answer made by you in this case you say you paid for the said stock to the Central Pacific Railroad Company of California the sum of $100. in money or its equivalent in value for each share. Will you state how much of that if any was in money and what was the nature of the equivalent in value that you gave or paid.

Mr. Sanderson.[underlined] Same objection and same advice.

A. And I decline to answer for the same reason as before.

Mr. Cohen.[underlined] 18 I submit to the ruling of the Notary
