on the fourth Monday Monday in April in the year 1849 for the sum of Two
Thousand three hundred and Seventy five dollars and 00 cents debt, and Four
Hundred and four dollars and Forty six cents damages, besides Two hundred
and Seventy five dollars and Forty seven & 1/4 cents costs. Uponthat judgment,
the said Steven S Ewing on the 4th Day of May 1849 obtained the writ of
Erro returnable to our Supreme Court to be held at Montgomery on the 1st
Monday in December next, and pursuant to the statute in such case, entered
into bond with security, in order to supercede the execution of said judgment
until the said writ of error should be determined. We therefore command you
to cite the said John E Standefer and others to appear before our said Supreme
Court at the next term thereof aforesaid, to hear and defend the errors, if any,
which the said Stephen S Ewing may .assign (let execution of said judgment
be accordingly superceded) and at least ten days before the said first Monday
in December next, have this writ and your return thereon, at the Office of
said Circuit Court, so that the service thereof may be certified to our said
Supreme Court Witness John B Eldridge Clerk of said Circuit Court of
Madison county, at Office, this the 22nd day of June in the year of our Lord
eighteen hundred and 49 and of American Independence the 73d year
