Marshall H Hooks
Now if the Said Bank of any person holding Said note Shall recover
Judgement on the Same against Peter C Harris & Marshall H Hooks
or against the Said Marshall H Hooks then the Said Hooks is hereby
authorized and empowered to take Said property into possesion and
to advertise the Said property for Sale and upon giving thirty days
notice in one of the newspapers in Montgomery and by giving thirty
day notice by posting up a notice of sale at the Court House in
Tuskegee Macon County and upon giving the aforesaid notice to
Sell the Same at public, Sale in the Town of Tuskegee and to dispose
of Such part of Said property as will be Sufficient to pay Said Judgement
and in the event that Judgement Should be rendered and the Said Hooks
Should not See proper to immediately Seize and take Said property but
Should let the Same remain in the possesion of the Said Harris and Should
Said Hooks have to pay any part of Said Judgment or all of the Same
there the Said Hooks is hereby authorized and empowered to take Said
property into his possesion and upon giving the notice aforesaid there
he is authorized to Sell So much of Said property as will pay and
Satisfy the amount of Said Sum paid as aforesaid by Said Hooks
2nd And this instrument further Witnesseth that whereas the Said
Peter C Harris is indebted to Thomas Stock in two promissory notes one
dated 7th March 1831, for the Sum of Six thousand dollars payable on or
before the 25th day of May 1837 Also one dated Nov 1st 1835 for five
thousand dollars payable on the 25th day of December 1831, Now in the
event that Said notes are not paid in Eighteen months from this date
and if the Said Harris Shall pay and Satisfy the Said note payable to
the Bank describd as aforesaid or any Judgement that my rendered
then the Said Hooks is empowered and authorized to take Said proper-
ty into his possession and give the notice as aforesaid and Sell the Same
and apply the proceeds in payment of Said notes and if the Said Harris
Shall pay and Satisfy the Said Bank before the expiration of the Eight-
een months as aforesaid and the Said Hooks Shall be So instructed
by the Said Stocks then the Said Hooks is authorized to Sell Said
property upon giving the notice aforesaid and the proceeds of such sale
to apply in payment of Said notes and he is authorized to Sell So much
of Said property as will Satisfy Said notes; And the Said Hooks
is hereby fully empowered to take Said property into his possesion
at the time as Set forth in this instrument and to Sell the Said
property as Set forth and is hereby authorized to make and Execute
all deeds and instruments of conveyances necessary to convey Said
