Frederick O.A. Sherrod was with William W.
Watkins and Richard Jones, joint executors of
said will, until the death of said Frederick O.A.
Sherrod, which occurred in November 1848, & that
after that time said Richard Jones resigned his
executorship, but at what time respondents do not
know. It is admitted said William W. Watkins
continued executor of said will after the resigna
tion of said Jones & the death of said Frederick.
Respondents admit that said William W.
Watkins resigned his said executorship and that
Charles F. Sherrod and Samuel W. Shackelford were
appointed administrators with the will annexed of
said Benjamin Sherrod.
Respondents state that it is true that said Ben
jamin Sherrod left two sets of children; that
Frederick O.A. Sherrod deceased, the father of these
respondents, and Samuel W. Sherrod, living at the time
of the death of Benjamin Sherrod deceased, Felix
A.M. Sherrod deceased & Mrs Antoinett Swoope de
ceased both of the last mentioned departed this
life before said Benjamin Sherrod deceased
& were brothers & sisters of the whole blood and
children by the first wife of said testator; that
Mrs Susan A. Shackelford, wife of said Samuel W.
Shackelford, said Charles F. Sherrod, & William C.
Sherrod are children of said testator by Mrs.
Talitha Sherrod, the second wife and now the
widow of said testator.
Respondents state that Samuel W. Sherrod
since the death of the testator has departed this
life & about the month of November 1848. That
Mrs. Antonett Swoope left a son named William
S. Swoope & that since the death of the testator
said William S. Swoope has departed this life
leaving no child nor descendant of a child or
widow. That said Samuel W. Sherrod left
children at his death as stated in the Bill.
That Felix A.M. Sherrod left a widow & children
as stated in the Bill, and that the said Fred
erick O.A. Sherrod left at his death a widow
Ann Sherrod, & these respondents his children
& also Francis Sherrod, who has since departed
this life an infant without descendants leaving
no indebtedness against her estate. These
respondents insist that under and by virtue of
said will of said Benjamin Sherrod, that they
are, with the children of Felix A.M. Sherrod and
