On this the 23^d day of August 1864 came George[?] Thigpin (and mind[?] his return upon oath to a writ of Habeas Corpus sued out against him by Patrick Freeley the petitioner for said writ of Habeas Corpus, the writ and the return being filed in this Court, and it being proved to the Court by the evidence offered that the said Patrick Freeley was not at the time of his enrollment[?] or before or since a resident of the County of Montgomery State of Alabama=

Is is ordered and adjudged that the said G Thigpen has no authority to detain the said Patrick Freeley as a member of said State Militia and that the said Patrick Freeley is discharged from his custody -
