Deposition of Charles Crocker in the case of County of San Joaquin vs. Central Pacific Railroad, examined on December 27, 1880 by A. A. Cohen Esq., attorney for the plaintiff and S. W. Sanderson Esq., attorney for the defendants. Charles Crocker along with Leland Stanford, Collis Potter Huntington and Mark Hopkins built the Central Pacific Railroad. Crocker was the Construction Supervisor for the Central Pacific Railroad.

Be it remembered that on this 27th,, day of December 1880 before me, the undersigned Notary Public in and for the City and County of San Francisco and pursuant to due Notice given appeared before me Charles Crocker a witness to be examined on the part of the plaintiff and also came A. A. Cohen Esq.. Attorney for Plaintiff, and S. W. Sanderson Esq.. Attorney for defendants and the said witness being by me duly sworn deposed as follows.

Deposition of Charles Crocker a witness sworn and examined on the part of the Plaintiff before E. V. Joice Esq. Notary Public Present A. A. Cohen Esq., Attorney for Plaintiff and Messrs Wilson and Sanderson Attorneys for Defendants.

A. A. Cohen[in left margin] Q 1 Mr. Crocker will you please state your name, age, place of residence and occupation.

A Well, my name is Charles Crocker; my age is 58; I am living for the present on California street in San Francisco, my occupation is railroading.

Q 2 Are you connected with the defendant the Central Pacific Railroad Company?

A I am second Vice President of the Central Pacific Railroad Company.

Q 3 Do you occupy any other position in the Company?

A I am a director.

Q 4 Any other?

A No — I am a stockholder.

Q 5 Are you connected with the defendant

A Yes Sir.

Q 6 Please state what the relation is?

A I am President of it.

Q 7 Are you connected with the defendant the California Pacific Railroad Company?

A I am a stockholder in it.

Q 8 Any other relation to it?

A I think not, I am not positive though. I think I am not a director in that, still I may be.

Q 9 Are you connected with the defendant the Potrero and Bay View Railroad Co.?

A I am a stockholder in it.

Q 10 And a director?

A I think very likely I am but I am not positive.

Q 11 How is it about the California Pacific Railroad Company are you a director in that?

A I am not positive whether I am or not.

Q 12 What is your relation with the Market Street Railway Company if any?

A I think I am the Vice President of that.

Q 13 And director?

A Yes.

Q 14 Were you a director of the Central Pacific Railroad Company of California?

A I have just told you I was — of California; was I a director?

Q. 16 At any time.

A. Yes.

Q. 17 State when you first became a director and how long you continued to be such?

A. I first became a director at the organization of the Company and I remained a director with 1861 some time.

Q. 18 Were you a director at any time after that of that Company?

A. Then I do not remember the dates of the consolidation of the Company but I came back into the Central Pacific Directory in 1869 in October. From the time I left it then I was not an officer again of the Central Pacific of California but I do not remember the dates of those consolidations.

Q. 19 In speaking of the Central Pacific Railroad Company in your last answer do you not mean the Central Pacific Railroad Company of California?

A. Well as I said before if there was a consolidation before the Fall of 69. I was not a director in it because from the time that I left its Directorship in 1861 until 1869 I was out of the Directorship.

Q. 20 Who succeeded you as a director of the Central Pacific Railroad Company of California?

A. I do not recollect sir.

Q. 21 Was it Mr. E. B. Crocker?

A. I am not positive whether he was a member before I resigned or not. I think he was still he may not have been the records of the Company will show that however.

Q. 22 Mr. E. B. Crocker is deceased is he not?

A. Yessir.

Q. 23 When did he die?

A. He died in June I could not tell you I cant remember certainly the year.

Q. 24 Was it '74 or '73?

A. I think it was 5 years ago 5 or 6 years ago.

Q. 25 How long were you a director of the Central Pacific Railroad Company before the consolidation you speak of?

A. I was from the date of its organization up to — I have not got my memorandum book with me — up to the time I resigned in 1861 I do not recollect exactly the date of that I think though it was in the Fall.

Q. 26 After that before the consolidation you have spoken of, how long were you a director?

A. After that before the consolidation.

Q. 27 Yes sir.

A. I do not know whether I was a director at all, before the consolidation because I do not remember the date of the first consolidation. Well then I was from October 1869.
