This, of course, is a desperate remedy; – a last resort.
Like every such remedy & resort, – it must be re-
-served for rare occasions, & the most trying emer-
-gencies. It must not be employed frequently,
nor for any trivial cause; – otherwise it is belit-
-tled, & made of no effect small consequence; &, in the end, produces
confusion, worse confounded ~

The state of things in California some years ago has
secured to the people to justify the use of this resort.
Their right to employ is being conceded, the propri-
-ety of the course must be determined by its expe-
-diency; and that, by the necessity & urgency of the
case. They have did resorted to it – whether for ultimate
good or evil, remains to has not failed to be seen. – we will hope
it will prove to have been for only good ~

Our first Legislature probably
with good no bad motives adopted a very lenient
criminal code – one of the most lenient ever
known. It gave the criminal every possible
advantage, – & attached the lightest penalties to
many crimes. Under it, conviction was
subject to all sorts of delays; – and, as it proved,
