The Deft. in this case was indicted at the late special June term of the Circuit Court of Warren County and convicted of murder.

The following is substantially the testimony in the case.

E. B. Willis, (White) sworn—

Lives in Warren County—Knows the Deft. & also knew Joshua Newell the man killed. On the day of the killing was absent from home but returned about dinner time—found Deft. at his house—asked him what he wanted Deft. said he had knocked old Joshua in the head with a hoe, said he had struck him hard & he thought he had killed him and that he would have struck him again if he had not supposed he was dead. It made but little impression upon him (witness)
