Dec. was struck with a common hoe—Dec. was severe in punishing his family.

I about 12 years old—Was in the field at the time of the killing—While Newell was whipping his daughter, Lovinia, the Deft. came up to him & struck him; a blow upon the head with a hoe & struck him again when he fell & was about to strike him again when Lovinia inter-fered & caught the hoe—Was standing about ten steps off—It was about 12.oclock. Dec. was whipping his daughter when Deft struck him & had been for five minutes or so—

When Lovinia caught the hoe she told Deft. not to strike any more & Deft replied I tried to kill him

Deft was plowing in the same field they were at work in near enough to hear Lavinia's screams, Dont know as Deft & Lavinia lived together or not—Deft & Dec. had lived together in the same house.
