assessing to the Mt Auburn Cemetery Corpo-
ration upon certain land, part of said
Cemetery, a part of the cost of a sewer on Mount
Auburn Street, and to enjoin William W. Dal-
linger, treasurer of said City from selling said
land;

and Whereas said Proprietors desire that the
said City shall not seek to enforce said assess-
ment by sale of said land, pending proceed-
ings upon said petition, and at the termina-
tion of said proceedings the lieu of the City
upon said land will probably have expired;

Now, therefore, the said Proprietors hereby agree
that if the City of Cambridge shall refrain from
taking any steps toward the sale of said land
pending said petition for certiorari, and if the
Court shall determine that said City had a
right by virtue of said proceedings of the Mayor
and Aldermen to enforce said assessment against
said Proprietors by sale of said lands or any
thereof, or if said Proprietors shall abandon said
petition, said Proprietors will pay to said City the
amount so assessed with interest thereon within
30 days after the termination of proceedings upon
said petition"
