Recognizance. When he came to that part
of the condition, specifying the Court, before
which he should appear, he inquired of the
Court
, whether he should be bound over
to the Circuit, or to the County Court (The County
Court had jurisdiction only, in cases of
simple assault & battery). After a short
consultation, they decided that he should
be bound, to appear before the Circuit Court.
He accordingly gave bail for his appearance.
His securities were Mark Hutchens
Wally Estell[?].
The next morning about daylight, a man
who lived next door to Mr. Campbell, came
to the room, of the dying man, to inquire
how he was. He was told, by Dr. [Denn?] that
his case was hopeless. He stayed but a
minute. He had come as the friend of
and messenger from A. who left town
immediately & went in the direction of
Huntsville: He resided in Pickens County
The same day or the next, a few patriotic
men, at the head of whom was David
Austin, went in pursuit of A. with the
determination, to bring him back, if they
could find him. They did not succeed.
They ascertained however, that he was at
a private house in Huntsville.
After the death of my son, I procured another
warrant, which I placed in the hands
of Austin, who with others, went again
to Huntsville, where A. still remained
they saw him, but did not succeed in
arresting him. One of the persons who
accompanied A. to Huntsville was Colo
