Caused a warrent to be issued, for their arrest
& thereby, stopped the duel!!
Well Col. G. Where did you get this story?
Ans: From his stepson I. S. who got it from
his sister in Kenty.
Now there was not one word in truth in
the latter part of the story - I had a personal
knowledge of all the facts myself & happened
to have and shall have, a Certificate
signed by the Hon. H. Clay, & the late Hon. W.
T. Barry both of whom were Trustees of the
University, stating that the matter had been settled
to the satisfaction of the friends, of & honorable to both
partners. Mr. Holly (Prest. of the University) had
by some means heard of the pending duel, he desired for
many reasons to put a stop to it, one of which was
that they could not be permitted to graduate
unless it was settled. There was a great deal
of such illegal incompetent stuff as this, allowed
by the Judge to be given in evidence - for what
purpose, it would be exceedingly difficult for an
impartial Judge or Lawyer to decide - Mr Greendy
the leading Counsel, was a veteran criminal
advocate, & in a bad case, he was sure if possible
to make the jury, loose sight of the case they
were trying
and direct their attention to something
else. In a case of this kind to excite them
against the deceased.
The Judge permitted, every thing that anybody
had ever heard about the Dwyer Case, to be given
in evidence. A witness would swear that he considered
Thos. T. a dangerous man. What is your
reason for that opinion? Ans. - Report said
he shot old Mr. Dwyer. Did you see it? No,
I did not - but I heard so & so. As before
