A BILL TO BE ENTITLED AN ACT TO [???] THE
DURHAM [???] [???] SCHOOL, THE STATE COLLEGE FOR COLORED
PEOPLE OF NORTH CAROLINA.
THE CENTRAL ASSEMBLY OF NORTH CAROLINA DO [???]:
Section 1. That the Durham State [???] School, located
at Durham, North Carolina, is hereby created, The State College for Colored
People of North Carolina, and shall be under such name a body politic in-
corporated and by that name shall have perpetual concession and a common
[???], and receive and possess all moneys, goods, and chattels that shall be
given for the use of mid State College, and to apply the [???], according to
the will of the donors, and by gift, purchase, or device, to receive, possess,
enjoy and retain forever any and all real and personal estate and funds, of
whatsoever kind, nature or quality the [???] may be, in special trust and con-
fidence that the [???], or profits thereof, shall be applied to and for the
use and purpose of establishing and endorsing the said State College for Col-
ored People; and shall have the the power to receive donations from any source
whatsoever, to be conclusively devoted to the purposes of the [???] of
said State College for Colored People, or according to the [???] of donation.
The corporation, by its corporate name, shall be able and capable in law to
bargain, sell, grant [???], or dispose of and [???] assure to the pur-
[???] any and all such real and personal estate [???] funds as it may law-
fully acquire when the condition of the grant to is or the will of tho do-
viser does not forbid it; and shall be able and capable in law and to one and
be sued is all court whatsoever; and in general [???] do all [???] things as
may be necessary for the promotion of learning and virtue among colored people
of the State.
Section 2. The General Assembly may make such provisions,
laws and regulations from time to time as may be expedient and necessary for
the maintenance and management of said State College, and shall provide that
the benefits of said College, as for as [???], be extended to the colored
people of the State.
Section 3. There shall be twelve trustees for the said
State College for Colored People, appointed by the Governor and confirmed by
the Senate, whose term of office shall be four years. The Superintendent
of Public Instruction of the State shall be [???}-officio Trustee of said State
College. In the trustee shall be vested all the rights, privileges, franchises
and [???] in any vice granted to or conferred upon the trustees of the
State College for Colored People or South Carolins; and said Board of Trustees
shall have the power to vacate the appointment and remove a trustee for in-
proper conduct, stating the cause of such removal on the journal; but this
shall not be done [???] at an annual meeting of the said Board of Trustees,
or at a special meeting of the Board of Trustees called for that purpose, and
there shall be present at said meeting thereof at least nine members of the
said Board. Whenever any vacancy shall happen in the said Board by reason of
