A BILL TO BE ENTITLED AN ACT TO CREATE THE
DURHAM STATE NORMAL SCHOOL, THE STATE COLLEGE FOR COLORED PEOPLE OF NORTH CAROLINA.

THE GENERAL ASSEMBLY OF NORTH CAROLINA DO ENACT:

Section 1. That the Durham State Normal School, located at Durham, North Carolina, is hereby created, the State College for Colored People of North Carolina, and shall be under such name a body politic incorporated and by that name shall have perpetual succession and a common seal, and receive and possess all moneys, goods, and chattels that shall be given for the use of said State College, and to apply the same, according to the will of the donors, and by gift, purchase or devise, to receive, possess, enjoy and retain forever any and all lands, tenements, or hereditaments, of any nature or kind, to use or apply the same as may be applied in trust for the education of the colored youth of the State, in special trust and confidence; and the same to sell, convey, mortgage, or dispose of, according to the nature and exigencies of the trust, the same being the State College for Colored People, and it shall have the power to receive donations from any source whatsoever, and to bequested, devised or conveyed of any estate or effects that may be contributed to said State College, according to the will of donors, with 30% of the property or estate, and no more, and be capable in law to purchase, enjoy, hold, and possess lands, and other things, and dispose of the same, according to the rules and by-laws prescribed by it and not otherwise.

Any lands and all such gifts received by the State of North Carolina may be fully acquired when the condition of the grant is if the will of the donor or donors require the said gift and when said State College is incorporated as aforesaid, and when the conditions of the grant require any special trust, the same shall be held and applied to the uses for which they may be donated, and for the promotion of learning and virtue among colored people of the State.

Section 2. The General Assembly may make such provisions, laws and regulations from time to time as may be expedient and necessary for the maintenance and management of said State College, and shall provide that the benefits of said College, as far as practicable, be extended to the colored people of the State.

Section 3. There shall be twelve trustees for the said State College for Colored People, appointed by the Governor and confirmed by the Senate, whose duties shall be to prescribe rules, regulations, and course of study for the said College. The Superintendent of Public Instruction of the State shall be ex-officio trustee of said State College for Colored People. The Governor shall have the right, within his discretion, to remove any of said trustees.

The trustees of the State College for Colored People of North Carolina, and Board of Trustees shall have power to select its own chairman and vice-chairman and to appoint and elect its own secretary and treasurer. The trustees shall meet annually and at such times as may be called by the chairman and upon the request of the majority of the said Board of Trustees, and all such meetings of the said Board of Trustees shall be subject to the call of the chairman of said Board.
