Sir:

Referring to your letter of 22 May, '03, asking the appointment of Mr. Fred J. Booth as Laborer in the Light-House Service, to care for the Yaquina Bar Range, Government Wharf, and Middle Ground Beacons Lights, Yaquina Bay, Oreg., with pay at the rate of $40. a month from 1 may, '03, in accordance with the provisions of Civil Service Rule 3 Section A, the Board states that it infers that you mean Civil Service Rule III. Section 8(a), which is now, under the Revised Civil Service Rules, Rule II. Section 3. The rate of pay which you recommend, $40. a month, is in excess of the rate allowed for Laborers appointed without examination, the limit being $300. a year.

The Board requests you to make further explanation in regard to the nomination of Mr. Booth and also requests you to state how these beacon lights have been cared for up to the present time, as the records of this office do not show that any Laborers have been authorized to care for them.

Sir:

Referring to your letter of 9 June, '03, relative to the appointment of Mr. Fred J. Booth as Laborer to care for Yaguina Bar Range, Government Wharf and Middle Ground Beacon Lights, Yaquina Bay, Oreg., and referring to the Board's letter of 13 May, '03, in regard to the localities in which post lights are to be maintained under the appropriation for Lighting of Rivers, the Board states that Yaquina Bay, in which these light are situated, does not come within the localities named in the appropriation for Lighting of Rivers. These lights are therefore beacon lights, as you designate them in the first paragraph of your letter, and not post lights, and the Laborer in charge of them should never have been paid from Lighting of Rivers. Instructions in regard to the payment of the Laborer, and the reasons therefor, to the end of the present quarter, have been given in a letter dated 18 June, '03. Your attention is also invited to a telegram, dated 23 Oct. '94, sent to your office, in regard to these lights.

The Board has to-day asked the Department to authorize a Laborer to care for the lights above-named, to date from

1 July, '03, with pay at the rate of $40. a month.

The Board has also asked the appointment of Mr. Fred J. Booth, pending selection from an eligible list. If you desire to continue the services of Mr. Booth it will be necessary for you to examine him and send his name on an eligible list as laborer, giving him due weight for experience, before he can receive a regular appointment, as the salary of the position is in excess of $300. a year, although the duties of the position do not occupy all the time and attention of the appointee. The Department will not consider the fact stated in your letter, that the pay is not for personal salary only.
