ORDINANCE NO. 138. AMENDING ORDINANCE NO. 110, ESTABLISHING GRADES IN THE CITY OF SEATTLE. Approved May 17, 1877. (Repealed by ordinance No. 140.)

ORDINACE NO. 139. IN RELATION TO THE DISCHARGE OF BALLAST, STONE, GRAVEL EARTH OR OTHER MATERIAL IN THE HARBOR OF THE CITY OF SEATTLE. Approved June 20, 1877. (Superceded by Ordinance No. 179.)

ORDINANCE NO. 140. AMENDING ORDINANCE NO. 138. ENTITLED "ORDINANCE NO. 138; AMENDING ORDINANCE NO. 110, ESTABLISHING GRADES IN THE CITY OF SEATTLE. Approved July 2, 1877. The City of Seattle does ordain as follows:

SECTION 1. -- That a base or datum line to which the grades of the City shall be referred is hereby established at an elevation of nine feet and six tenths of a foot (9 6-10) below the level of the top of the granite step in the doorway of Dexter Horton & Co.'s stone bank building on Commercial Street at the corner of Washington street.

SEC. 2. -- That the grades for the streets of the City shall be at the following elevations above datum:

ly violating the forgoing provisions shall be deemed guilty of misdeameanor and on conviction before the Justice of the Peace of the City, shall be punished by a fine not exceeding twenty-five dollars, or by imprisonment not exceeding twenty -five days or both, at the discretion of the court, for each and every offence. Any conductor or other employee on the railroad herein provided for, any passenger thereon, or other person on or about the cars belonging thereto, who shall by offensive, indecent, opprobrious or abusive language, insult, abuse or maltreat any passenger on the said cars, shall on conviction thereof before the Justice of the Peace of the City, be punished by a fine of not less than five nor more than twenty-five dollars, or by imprisonmenr not exceeding twentydays, or both, at the discretion of the court, for each and every such offence.

Sec. 7 - the construction of the railways herein provided for shall be commenced within sixteen months from the 1st day of October, 1879, and the same shall be completed as follows: The railway on Commercial Street and along Mill Street from the intersection of Commercial to the intersection of Front Street and along Front Street as the same shall be graded, shall be completed within twenty-three months from said 1st Day of October 1879, or so soon thereafter as said streets or parts of streets shall be graded. The railways upon at least 133

one street herein named, shall be completed each year thereafter, until the railways upon all the streets named herein shall be completed: Provided[italics], that on or before the first day of July, A.D. 1880, the said Irving Ballard or his assigns shall give notice to the Common Council naming the streets upon which it is intended to construct railways as herein provided during the year next ensuing the date of such notice, and the railway on such street or streets so designated shall be completed within the said ensuing years, so far as the same shall be graded, and on the first day of July of each succeeding year thereafter a like notice shall be given to the Common Council designating the street or sreets upon which the railway is to be constructed the next ensuing year as before, until the entire system of railways provided for herein shall be completed: Provided further[italics], that said railway when laid down and completed upon any street or streets herein named and as herein provided, shall be extended upon such street or streets whenever the graded portion of such street or streets shall be extended; such extension of railway upon any street to correspond and to progress with the the street improvements on said street.

The waiting room is situated most convenient to the corner of Commercial Street and Yesler are where so many car lines pass and also where the drinking fountain is situated The triangular area includes on its apex near the converging of Front and Commercial Streets. A drinking fountain for animals accessible from all sides the same is surmounted by groups of incandescent lights. The Triangle proper is separated from the Road-ways by a curb stone all around. Inside of which is indicated a line of ornate parts every fourth of which is converted into and incandescent light candelabra these parts are intented and will protect the triangle form the encroachment of teams and if experience demands mineral protection said parts could be linked by chains To the east of the pavillion is indicated a representative timber flag staff. the pavements of the triangle surface is consists of collard concrete tiling.

5 COMMON COUNCIL OF THE CITY OF SEATTLE Oct 14, 1881 Be it remembered that on this the 14th day of October 1881 the Common Council of the City of Seattle meets in its Council Chamber pursuant to adjournment The following Officers are present, to wit: His Honor the Acting Mayor John Collins and Concilmen Thos Clancy, Wm A Jennings, John Keenan, Moses Keyzer and Chas McDonald Thereupon the following proceedings are had: The following claims having been duly audited by the Council and ordered paid by Warrents drawn upon the funds and in the amounts following to wit: Road Fund Robt Russell Hauling lumber $5.50 Moses Keezer Extra work on 8th St Sidewalk $6.00 Fire Fund John Maginnis Engine Steward $4.00

And now the City Surveyor makes his report showing that Moses Keezer the Contractor has fully completed the 8th Street side walk under Ordinance No 2 43 according to the plans and specifications thereupon it is ordered that a Warrant be drawn in favor of Moses Keezer in the sum of $523.00 on the fund to pay for said improvement Ordered that a Warrant be drawn infavor of F H Whitworth in the sum of $58.00 on the Fund to pay for the 8th Street side walk constructed under Ordinance No 243 in fullfor his services as Surveyor on the improvement. Ordered that the Ordinance Committee be and they are hereby requested to confer with J W Ackerson & others and the Seattle Lumber & Commercial Co. to see what arrangements can be made relative to the Ballast Wharf Ordered that a warrant be drawn in favor of James M Colman for the amount of interest due on the Commercial Street Grade warrant No 11 Ordered that the petition of Bailey Gatzert asking to have the alley in Block 48 of Terry and McNaughts 2nd Addition be & the same is hereby laid on the Lable Ordered that the petition of O S Wright & others praying
