be signed by "Seymour L. Tooker clerk" and plaintiff alleges that at the date of said deed Seymour L Tooker was one of said Trustees, and clerk of the Board. And plaintiff further alleges that said instrument purporting to be a deed to the defendant Harry Bisgood was made without any authority from the plaintiff and without the knowledge or consent of the members of said Trustees other than said Tooker and Dominy. Plaintiff further alleges upon information and belief that the execution of said instrument purporting to be a deed to defendant Harry Bisgood was procured by the defendant Nathaniel Dominy without any consideration to plaintiff and upon an understanding and agreement between said Bisgood and Dominy that said Bisgood was to immediately execute a conveyance of the premises therein described without consideration to said Dominy. And in pursuance of said agreement said defendants Harry Bisgood and Fanny P. his wife executed the instrument above described to said Dominy. Wherefore plaintiff demands judgement that said instruments be set aside and cancelled of-record and that plaintiff may have such other or further relief as to the Court may seem just and equitable with the costs of the action. Supreme Court Suffolk County The Trustees of the Freeholders and Commonality of the Town of East Hampton, Plaintiff against Harry Bisgood and Fannie P. his wife, Nathaniel Dominy and Mary his wife Defendants Plaintiff complains of the defendant and alleges - That the plaintiff is a body corporate and incorporated by and under a certain colonial charter or patent granted by Thomas Dongan then governor of the province of New York under James the second King of England and dated December 9th 1666 which said charter has been duly acknowledged ratified and confirmed by and under the constitution and laws of the State of New York That the plaintiff is the owner of all that tract of land and land under water situated in the town of East Hampton, Suffolk County, State of New York extending in front of the shore line commencing at highwater mark on the eastern side of the Sag Harbor wharf in the village of Sag Harbor in said town and following the indentations of the shore line and of land and land under the water of Brinley D. Sleight and Robert J. Power and extending one thousand feet into the bay in front of said line. Also

all that other tract of land and land under water situate in the said town of East Hampton extending in front of the shore line at Abraham's Point landing and following the indentations of the shore line and including Napeague Harbor to Montauk Point and extending along such shore line one thousand feet into the water, that on the 21st day of April 1884 at 12 oclock M. an instrument dated March 18, 1884 purporting to be a deed from the plaintiff, to the defendant Harry Bisgood was recorded in Suffolk County Clerk's office in Liber 281 of deeds at page 39 which instrument pruported to convey to said Bisgood for a consideration of ten dollars the premises above described. That on the 21st day of April 1884 at 12 oclock M. an instrument dated March 19th 1884 purporting to be a deed from the defendants Harry Bisgood and Fanny P. his wife to defendants Nathaniel Dominy was recorded in said clerk's office in Liber 281 of deeds at page 41 which instrument purported to convey to said Dominy the same premises described above. That at various times since the date of recording said instrument the said Dominy has exercised acts of possession over said premises and claims to be the owner thereof. That at the date of said deeds the defendant Nathaniel Domine was a member of the Trustees of the Freeholders and Commonality of the town of East Hampton and said instrument purporting to be a deed to the defendant Harry Bisgood purports to
