Be it Resolved, Hon Mayor & City Council.

Gentlemen.

Petitioner would respectfully state that he
paid in October 1897. Occupation tax as a Horse
Peddler, since then the law has been held uncon-
stitutional, and the county had refunded to me
the amount paid it. I herewith append the
receipt for amount paid Assr & Collector $7.50 and
ask you to refund same to me.

Gentlemen

Subdivision 21. page 51, acts of 1897 special session 25th by
informing a tax on foot and horse peddlers was held unconstitutional
by the court of ciminal appeals. Ex facto Jones 43 S.M. 513.
The tax imposed on peddlers cannot be collected under the state law
or under our city ordinance which is imposed by authority of
the state law.
