We, your Committee on Finance recommend That the Report of W. B. Harrison City Treasurer for the month of March 1901 showing balances on hand at the close of business Mch 31, 1901 aggregating the sum of $132,019.98 be approved same having been examined by the City Auditor and found correct.

April 18, 1901.

The Honorable the Mayor and City Council, Fort Worth, Texas.

Gentlemen:-

The attached copy of notice to John Lalla and certificate of the City Engineer of the personal delivery of the original to said Lalla was referred to me by the City Council at its last regular meeting.

The City assumes no risk and denies all responsibility for damages to private property occasioned by surface water flowing in natural channels. Neither does the City propose giving notice to persons carelessly or wilfully building within such channels.

But in this case, the danger was great, involving possible loss of life, that the City Engineer desired to influence Mr. Lalla to take obviously necessary precautions and wished also, in case of future injury and damages,to show the exercise of all possible diligence on the part of the City and for these reasons,gave notice and reported his action to City Counsel.

I suggest that his report be received and filed.

Mr. John Lalla, Fort Worth, Texas.

Dear Sir:-

You are hereby notified that your house on part of Blaock 69 of the City of Fort Worth, in Tarrant County, Texas, has been erected and now stands over the natural course of the hollow or gully that drains surface water from the West to the East across said Block 69, and that a part of the supports for the said house are planted directly within the said hollow or gully and in the natural couse or current of any water flowing therein, so that with the first and every suceeding heavy rain that falls in Fort Worth, the surface water draining across said Block will strike the suports of the said house and will endanger its safety and put all occupants in peril. Therefore, you are notified that the position of the said house and of its supports is unsafe and dangerous, and that, if the same be continued as they now stand, it must be at your, own, sole risk and peril.
