ORDER OF BOARD OF COMMISSION ON REPORT OF COMMISSIONER ON STREETS AND PUBLIC GROUNDS CONCERNING THE PAVEMENT OF Third Street from the east side of Main Street to west side of Rusk Street, and Fourth Street from the west side of Main Street to east side of Houston Street, and Tenth street from the east side of Houston Street to the west side of Main Street and Tenth Street from east side of Main Street to west side of Rusk Street and Eleventh Street from the east side of Throckmorton Street to west side of Rusk Street and requiring abutting property owners to comply therewith.

The report of the commissioner of Streets and public grounds recommending that Third street from east side of Main Street to west side of Rusk street, and Fourth street from west side of Main Street to east side of Houston Street, and Tenth Street from the east side of Houston Street to the west side of Main Street, and Tenth Street from east side of Main Street to the west side of Rusk Street, and Eeventh Street from the east side of Throckmorton Street to west side of Rusk Street not including intersections of said street with Houston and Main streets.

should be paved with bitulithic pavement coming on to be heard and the Board of Commissioners there upon and also upon their own motion having carefully considered the necessity and advantage of paving said sections of said streets in the manner requested, and it appearing to the board of commissioners that there is a public necessity for having said streets paved with said material, and it further appearing that so paving said section of said streets will increase the value of the property abutting upon said sections of said streets respectively in a sum equal to or greater than the cost of constructing said pavement in front of the respective properties abutting on said streets.

It is therefore hereby ordered that the owners of property abutting on said sections of said streets be and they are respectively called upon to construct said improvement in front of their several properties respectively and that they construct said pavement in accordance with the said specifications referred to in said recommendation, which specifications are recorded on pages 505-6-7-8-9 of Book R of the minutes and proceedings of the Board of Commissioners of the city of Fort Worth; the said call upon said property owners is intended to embrace all that part of said sections of the said streets in front of their several properties

respectively from the curb to the center of the said respective streets except in case where there is a street railway track on said street and in such cases is intended to embrace the territory from the curb in front of their respective properties to a line 18 inches without the nearest street car rail.

And it is further ordered that

being the owner and operator of a line or lines of street rails way on

be called upon and it is hereby called upon to construct the said improvement on the said streets whereon it has street car tracks over all the space between its rails of its track or tracks and the space between its tracks where it has a double track and between its side track or switches and the main track and for 10 inches on the outside of the outer rail of all such tracks side tracks, switches, etc.

And it is further ordered that this order, not including said specifications referred to, be published in the official newspaper of the City of Fort Worth, to-wit: The Fort Worth Star, once a day for ten consecutive days in order that the persons owning property on said sections of said streets or any of them, may have due notice there of and in order that if any person owning property on said sections of said streets or any of them, be unwilling to pay the cost of constructing said improvement in front of the property owned by him or her that such person may file or cause to be filed his or her objection or protest thereto on or before the next regular meeting of the Board of Commissioners after the final publication of said

I hereby certify that the foregoing order was duly presented and unanimously passed by the board of commissioners of the city of Fort Worth at a session held August 27, 1907.
