Fort Worth, Texas, December 17th, 1907.
To W.J. Estes, City Secretary, City of Fort Worth, Texas.
We hereby give you notice, as City Secretary of the city of Fort Worth , that on the 9th day of November 1907 in the city of Fort Worth, Texas, Mary Ellen Whitfield, wife of Jihn Roberts Whitfield while walking upon the streets of the city of Fort Worth and while walking along one of the public sidewalks of said city of Fort Worth, between Main & Houston streets on Fourth Street, the said Mary Ellen Whitfield, wife of John Roberts Whitfield, while in the exercise of due care and precaution, ran into and against a large piece of stone, about one foot thick, two feet wide and about four feet long, which was then and there situated on the sidewalk of the city of Fort Worth by the Deleware Hotel Company and was permitted to remain there by the City of Fort Worth. That said piece of stone and obstruction was negligently & carelessly left laying upon said sidewalk in violation of the city ordinance whilst it was the duty of the City to keep its streets from obstructions. That said piece of stone was about the color of said sidewalk and that the same protruded upon and into the sidewalk, and plaintiff's wife, not seeing the same, and by the exercise of due care and precaution could not see the same, struck the same with her legs and injuring her right leg; injuring her hip, back, neck and shoulders and otherwise injuring her internally, the exact nature of which plaintiff is at this time unable to tell, but states that by reason of said injuries, she is permanently injured and that the same was caused by the negligence of the City of Fort Worth, it's agents and employees, for all of which injuries she claims damages by and through her said husband against the City of Fort Worth, for the sum of Ten Thousand DOLLARS.
