CHARLES KASSEL
ATTORNEY AT LAW
4133 FORT WORTH NATIONAL
BANK BUILDING
FORT WORTH, TEXAS
Feby.19,1908
To the Honorable Commissioners of City of Ft Worth,
City
Dear Sirs:
During last October the City of Fort Worth sold to A.O.
Harvey, who in turn sold to A.G.Ilseng whom I represent, the upper
fifty feet of the lower eighty feet of Block W, Bellvue Hill
Addition to Fort Worth, having prior thereto, namely, on October
1st, 1907, created an extension of Boid D'Arc Street out of the
lower thirty feet. It appears from actual measurement that after
allowing, the thirty foot strip as actually laid by the City
Engineer only forty eight feet remain between the north edge of
the street and the south line of the property of Dr. Lloyd Pollock,
whose corners, as he informs me, were marked for him by an Assistant
to former City Engineer Hawley. It seems that all parties north
of the lot sold by the city to Mr. Ilseng have no more than the
proportions of land to which they are entitled, and it would seem
clear therefore that the newly created portion of Bois D'Arc
Street has been laid out so as to overlap by two feet the property
conveyed to Mr.Ilseng, and this is turn may be due to the fact
that the proprietor immediately south of the new portion of Bois
D'Arc Street has encroached to a like extent upon the land of
the City.
In view of the conveyance and warranty of fifty feet by
the City and its creation of the street at this point, I trust
the Commissioners will order made a careful survey and an exact
determination of the street lines. The City Engineer seems of
opinion that his office is without the data which will enable
