A PETITION TO THE HONORABLE MAYOR AND BOARD OF COMMISSIONERS FOR STREET IMPROVEMENT

We, the undersigned owners of property upon Pennsylvania Ave in the City of Ft. Worth, whose property occupies more than one half of the frontage upon the section of said street herein to be improved respectfully petition your Honorable body that said street be improved from its intersection with the west line of Eight Ave to the east line of adams Street as follows to wit:
Ist- That said street be properly raised and graded and filled by said city of Ft. Worth at its own expense.
2nd- That concrete or stone curbing be installed along the property curb of all said property at proper line and grade, to be done under the supervision of the City engineer, unless such curbing has already been installed at proper lines and grades.
3rd- A concrete guttering 24 inches in width be installed along each curb line in said street, the same to be measured and paid for as paving, except where concrete guttering has already been, and is now, properly installed at proper grade, in which event the same should be allowed to remain, and such property owners where the same is now installed to receive credit for same at same rate of cost of paving said street.
4th- That said street be paved with bithulithic paving in accordance with Warren Brothers specification on file with the City Secretary of the City of Ft. Worth.
5th- If it shall be desired by any of the property owners whose property fronts on said part of said street that a park be installed in the middle of said street then each party owning property within said section shall express, along with his or their signature, said perference in favor of or against any such park, and it is hereby agreed by each person signing this petition that the installation of such park shall be fully determined by the wishes of a majority of the front footage on said street, as expressed by the property owners as above mentioned, providing, that if any such park is to be installed, there shall be a roadway 22 feet in width on each side of said park and next to the property curb line.

6th- The cost of making said improvements shall be as follows-
a. That the City of Ft. Worth shall pay the cost,if any, for the putting of said street on proper grade by filling and grading the same as mentioned in paragraph 1st as above stated and said City shall pay for the improvements of the intersection of said street with other streets, and for the installation and curbing of any parks that may be installed as above mentioned, except such portion of such intersection of said street as may be occupied by street car lines, in which event the Street railway Company owning such street-car line shall pay the cost of improving such intersection between the rails and tracks of the said Street Railway Company and eighteen inches on the outside of its said rail.
b. The cost of making said improvement between the rails and the tracks and eighteen inches on the outside of the Street Railway Company whose rails and tracks extend along said street shall be wholly payed by said Street Railway Company.
C. That the remaining cost of such improvements being the cost of improving said street in front of the property of owners abutting thereon from the curb line, including said curbing, where the same has not already been installed, to a point 18 inches from the outside of said rail and tracks of said Street Railway Company where such rails and tracks exist, and where there is no such Street Railway Company lines to the middle of said street, shall be borne and paid for by the respective owners of the property abutting on said street, save and except where there may be installed in the middle of said street a park as herein before mentioned, then such property owners respectively shall pay said cost from said curb line as afore said to the outer edge of the curb line of such park.
7th- That the said improvement shall be made and the cost thereof assessed according to the Charter and Ordinances of the City of the city of Ft. Worth, pertaining to such improvements.
8th- That all said street improvements shall be done under the supervision and subject to the inspection and approval of the City engineer of the City of Ft. Worth.

9th- That the undersigned respectively agree that they will each obligate them-selves to the contractor to whom such work of improvement may be let by the City of Ft. Worth, in a manner satisfactory to said contractor to pay that part of said cost herein specified to be paid by each respective owner of property for improvements in front of his or her property.
10th- This petition is conditioned that the cost of making such improvements an excavation to the full depth of the pavement and a guarantee in the shape of a bond for ten years maintenance of such bithulithic pavement, shall not exceed the price of $2.35 per square yard and 35 centrs per lineal foot for said concrete curbing .

Fort Worth, Texas.
TO THE BOARD OF COMMISSIONERS, Of the City of Fort Worth,
Now comes Sam Davidson, Commissioner of Streets and Public Grounds, and reports to the Board of Commissioners, that in his opinion Pennsylvania Ave. being a public street and thoroughfare in the City of Fort Worth should be paved with Bitulithic pavement from the east line of Adams St. to the west line of 8th Ave. in order to make the same suitable for travel, and that a public necessity exists for such pavement and that the value of property abutting on said street will be enhanced in value in a sum equal to cost of such improvement - that in his opinion the said pavement should be made of said material named, and that the same should be constructed according to the specifications as the same appears of record on pages 550-1-2-3-4-5-6 and 557 inclusive of Book R of the minutes of the meeting of the Board of Commissioners of the City of Fort Worth, Texas, and that he therefore recommends to the Board that it enter into consideration of the necessity of such improvement, and the construction thereof, and that after due consideration the Board of Commissioners in due form pass an order declaring that the owners of property abutting onsaid street are called upon and calling upon them to construct said pavement in front of their respective properties,
and that the same be published for ten days as required by Ordinance No. 28 of the City of Fort Worth, etc., And should any person owning property abutting on said street be unwilling to pay his part of the cost of constructing said improvement in front of the property owned by him or her, then such person shall file or cause to be filed his or her objection and protest thereto on or before the next regular meeting of the Board of Commissioners after the final publication of this order.
