Sir I have the honor to enclose herewith certain affidavits processed by Sub Ind Agent M. B. Lewis in explanation to the exceptions taken to his accounts for the 2d Qr. 1859. Also his accompanying letter of explanation.

State of California County of Fresno
Be it remembered that on this Twenty Fourth day of November AD 1860 before me the undersigned, E. C. Winchell a Notary Public, duly commissioned and qualified in and for the County of Fresno in the State of California aforesaid, personally appeared L. G. Hughes, a resident of Fresno County aforesaid to me personally known for the period of seventeen months last past as a gentleman possessing a high representation for honor, veracity and integrity in the County and State aforesaid, who, being by me first duly sworn according to Law, did solemnly depose as follows, to wit:
That during the fiscal year commencing on the first day of July 1858, and ending on the 30th day of June 1859 inclusive, he was engaged in the mercantile business in the Town of Millerton in the County of Fresno aforesaid, and at the special instruction and request of Mr M. B. Lewis, Sub Indian Agent at the Fresno Indian Agency in said County he sold and delivered a large amount of goods, wares, merchandise and produce, for the use and consumption of the Indians belonging to and connected with said Agency, and that deponent's account for the same was long since rendered to said

M. B. Lewis, and, as he is informed and believes, was duly presented by said Lewis, for allowance and payment to the proper officers of the United States Government. That the goods, wares, merchandise and produce so sold and delivered during said fiscal of 1858,-'9 and included in the deponent’s aforesaid accounts for that period, were, with the exception hereinafter specified, always, and in every instance, delivered either to the said M. B. Lewis, Sub Indian Agent himself in person, or to some of the employees of the said Indian Agency in person, by the express authority of the said M. B. Lewis, or were delivered and distributed to the Indians belonging to said Agency in the presence and by the express direction of said M. B. Lewis or in the presence and by the express direction of some one of the employees of the said Indian Agency, who was by the said M. B. Lewis authorised to act for that purpose. And that in no case, (with the one exception following,) were any of the articles included in the deponent's accounts for said fiscal year 1858,-'9, delivered to any Indian or Indians whatsoever upon the written or verbal orders of M. B. Lewis or of any other person, unless in the actual presence and with the express approval of said Lewis himself or of some employee of the Fresno Agency
