This Indenture made this tenth — day of March — in the year of our Lord one thousand seven hundred & ninety four, between Peter Price of Henrico County of the first part, Barrett Price & James Price of the same county of the second part, & Elisha Price also of the said County of the third part, Whereas the said Barrett & James Price severally stand bound as securities for the said Peter Price by one bond or obligation for the said Peter's faithful performance in his office as a deputy sheriff of the said County of Henrico for the years 1785 & 1786 And whereas the said Barrett Price stands also bound as security in one other bond or obligation unto William Reynolds of the said County in the sum of ₤ 250 Certs upon which suit is now depending And the said Peter Price being willing & desirous, as far as in him lyeth, to secure & indemnify the said Barrett and James of and against the said two several bonds above mentioned hath for and in consideration of the premises aforesaid and of five shillings currency to the said Peter in hand paid, and by these presents doth grant, bargain, sell, assign, transfer, alien enfeoff & confirm unto the said Barrett and James Price, their heirs, and assigns forever, the following property, to wit, one negro fellow named Billy, one other negro named Lender, one negro boy named Billey, one other negro boy named James, one negro woman named Sarah, one negro girl named Amey, together with all the future increase of the said female negroes, also one small bay mare, one Gray Horse [inserted above: one Bay Do. one Bay Mare one Eye Out] four Cows, one Waggon, and one Cart, also three beds, bedsteads & furniture, Eleven Green Winson Chairs, twelve Leather bottom chairs, three Trunks, two Walnut Tables, one Mahogany Table, one pine writing desk, one half dozen knives & forks, one dozen & half plates & six dishes of Queens China, also the
the kitchen furniture, and plantation utensils of every nature and kind whatsoever, To have to hold the said four male negroes, and three female negroes, with all the future increase of the said female negroes, and also all and every the other species of personal property herein before enumerated and set forth unto them the said Barrett & James Price their heirs & assigns, to the only proper use and benefit of them the said Barrett & James their heirs and assigns forever. Upon this Special trust, and confidence that in case hereafter, the said Barrett & James their heirs or assigns shall be compelled to pay any sum or sums of money, for or on account of the said two several recited bonds, to which they are securities as aforesaid, It shall be Lawful for the said Elisha Price his heirs, exors, admors or assigns, upon giving ten days notice in any of the Richmond Newspapers, to expose to sale, all or any part of the said Male Negroes, female negroes and their increase, and all and every the other species of personal property herein before enumerated, and set forth, and dispose thereof to the highest and fairest bidder, and the money arrising from the said Sale to apply to the purpose of rembursing them the said Barrett & James Price their heirs & assigns in any sum or sums of money they may be compelled to pay on account of their said Securityship And also sufficient money to defray the expences of drawing this trust deed, the said advertisement, the recording hereof, and all incidental expences accuring hereby; and if any surplus should arrise after discharging the said bonds the interest thereon and the other expences hereof, the same shall be paid to the said Peter Price, his heirs and assigns.
