Whereas by an indenture made the fifteenth day of October 1835, between Geoge [George] Woodfin and Susanna his wife of the first part, and Henry L Carter, George K. Crutchfield, and Abner Ellyson of the second part; The said George Woodfin and wife conveyed unto the said Carter, Crutchfield and Ellyson a certain tract of land in the parish of St Peters and County of New Kent, containing four hundred acres more or less, bounded by the lands of Crump formerly Savage, Abner Ellyson, John B Christian and others, and Black Creek, together will all the buildings and other improvements thereon, and the privileges and appurtenances of every kind thereunto belonging; also all the personal property then being upon the said tract of land, consisting of a negro man named Charles, seven head of cattle, a bay mare a mule, about twenty head of hogs, growing crops, farming utensils and other articles; also all the personal property which the said Woodfin then had in the City of Richmond, the articles constituting which personal property were particularly enumerated. In trust nevertheless that upon the death of the said Susanna Woodfin, the whole property thereby conveyed which might then remain and the profits which might then be in the hands of the said trustees or any of them or the representatives of any of them, should be conveyed, delivered and paid over to such person or persons and in such proportions as the said Susanna Woodfin should by her last will and testament prescribe and direct, which last will and testament it was declared she should have power to make and execute in like manner as if she were a feme sole. But if not valid disposition of such property and profits should be made by the said Susanna Woodfin by last will and testament, then the same should upon her death be conveyed, delivered and paid over to the children of the said Susanna Woodfin living at the time of her death, and the descendants of such children as might then be dead, the descendants of any deceased child together taking the same part which such child if living would have taken, but with this proviso

proviso that John M. Woodfin the eldest son of the said Susanna was not nor were his descendants in case of his death before the said Susanna to have any part of the property or profits which should be so conveyed, delivered and paid over, all which will appear by reference to the said indenture which was duly recorded in the Court of Hustings for the City of Richmond, and in the Court of New Kent County. And whereas the said Susanna Woodfin has died without making any last will and testament leaving besides the said John M Woodfin the following children living at the time of her death to wit; Susan M the wife of John Carter, Francis Ann Woodfin, Nancy Joanna Woodfin; Amanda Maria Woodfin, and William George Woodfin and no descendants of any other children

Now therefore this indenture made this 18th day of April, in the year one thousand eight hundred and thirty seven, between Henry L. Carter, George K Crutchfield and Abner Ellyson of the one part and Susan M Carter who before her intermarriage with John Carter was Susan M Woodfin, Frances Ann Woodfin, Nancy Joanna Woodfin, Amanda Maria Woodfin, and William George Woofin [Woodfin] of the other part; witnesseth that the said Henry L Carter, George K Crutchfield and Abner Ellyson for and in consideration of the premises and of the sum of five dollars to them in hand paid by the said Susan M Carter, Francis Ann Woodfin, Nancy Joanna Woodfin, Amanda Maria Woodfin, and William George Woodfin before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold and delivered and by these presents do grant, bargain, sell, and deliver unto the said Susan M Carter, Frances An [Ann] Woodfin, Nancy Joanna Woodfin, Amanda Maria Woodfin, and William George Woodfin the whole property real and personal which was conveyed to the said Carter, Crutchfield and Ellyson by the indenture herein before recited, made the fifteenth

fifteenth day of October 1835 and all the right of them the said Carter, Crutchfield and Ellyson to the profits of the said property, no such profits however having yet come to the hands of the said Carter, Crutchfield and Ellyson, or the hands of any of them. To have and to hold all the said property real and personal, and all right to the profits thereof unto them the said Susan M. Carter Frances Ann Woodfin, Nancy Joanna Woodfin, Amanda Maria Woodfin and William George Woodfin their heirs, executors administrators and assigns. To the only proper use and behoof of them the said Susan M Carter, Frances Ann Woodfin, Nancy Joanna Woodfin, Amanda Maria Woodfin, and William George Woodfin their heirs executors administrators and assigns forever. In testimony whereof the said Henry L Carter, George K Crutchfield and Abner Ellyson have hereunto set their hands and affixed their seals on the day and year herein before mentioned as the day of making the same. New Kent County to wit, We Pilemond C Jones and Nathl. [Nathaniel] L Savage Justices of the peace in and for the county aforesaid, do hereby certify that Abner Ellyson a party to a certain deed bearing date the 18th day of April 1837, and hereto annexed personally appeared before us in our county aforesaid, and acknowledged the same to be his act and deed and desired us to certify the said acknowledgment to the clerk of the Court of Hustings for the city of Richmond and the clerk of the county Court of New Kent County in order that the said deed may be therein recorded Given under our hands and seals this 17th day of June 1837 Philemon C Jones seal Nathl [Nathaniel] L Savage seal

Carter & George K Crutchfield, parties thereto, and with the certificate thereafter written, of the acknowledgment of Abner Ellyson, also a party thereto, admitted to record Teste, Chs.
