Mr Apple has sent his resignation to the Trustees and proposes to this committee to liquidate his debt by transferring to a new party his unexpired lease together with his fixtures, improvements trees plants &c for a sum sufficient to indemnify this corporation.

The committee find that competent persons stand ready to assure the lease and pay the debt of Mr Apple to the corporation, on being duly authorized so to do by action of the Trustees

The committee therefore recommend that following vote the resignation of Mr Apple be accepted, and that the Trustees proceed to the choice of a Gardener

[below paragraph has "X" through it in pencil]

Voted -- That W H Spooner be appointed gardener pro tem for the remainder of the current year, on his paying to this corporation the whole amount due to them from Anthony Apple, being not less than $1074 after which he shall be entitled to contract with Mr Apple for a transfer to said Spooner of the lease of the garden now held by said Apple with all the appenditures and privileges thereunto appertaining. The whole transaction to be made satisfactory to the Committee on Grounds.

The committee on Grounds to whom was referred the resignation of Mr Anthony Apple as Gardener to the corporation beg leave to report --

That in a lease was executed to Mr Apple of the piece of ground now occupied by the garden, greenhouse and stone cutters shop, for ten years at a rent of thirty dollars, the corporation having the right to reserve the premises at any time after three months notice, on paying the said Apple the estimated value of the improvements made by him thereon, not exceeding the sum of $15 00.

Mr Apple has been accustomed to employ in his operations certain workmen attached to the cemetery, and to pay for their labour a stipulated price. But this year owing to sickness and want of [savings?], he has failed to pay his arrearage, and is now in debt to the corporation about $1074.
