That, in 1858, a lease was execu-
ted to Mr Apple of the piece of ground
now occupied by the garden, greenhouse
and stone cutter's shop, for ten years at
a rent of thirty dollars, the corporation
having the right to resume the premises,
at any time after three months notice,
on paying the said Apple the estimated
value of the improvements made by him
thereon, not exceding the sum of $1500. ~

Mr Apple has been accustomed to
employ in his operations certain workmen
attached to the cemetery, and to pay for
their labour a stipulated price. But
this year, owing to sickness and want of
success, he has failed to pay his arrearage
and is now in debt to the corporation
about $1074. ~

Mr Apple has sent his resigna-
tion to the Trustees and proposes to
this committee to liquidate his debt by
transferring to a new party his unexpired
lease together with his fixtures, improve-
ments, trees, plants, &c. for a sum suf-
ficient to indemnify this corporation.

The Committee find that competent
persons stand ready to assume the lease
and pay the debt of Mr Apple to
the corporation, on being duly authorized
