cut off a wedge from the land heretofore conveyed,
to the said Mary Hemenway, and the said Mary
Hemenway
is desirous to take are equivalent
amount of land upon the westerly side of said
fountain
in Exchange therefor.

Now this Indenture
witnesseth that the said Proprietors of the Cemetery
of Mount Auburn, in consideration of the premises,
and of the release hereinafter made on the part of
the said Mary Hemenway, hereby grant, bargain,
sell and convey to the said Mary Hemenway, her
heirs and assigns forever, the two parcels of land
marked A and B upon the plan hereto annexed,
(a duplicate copy of said plan being entered with the
records of said Corporation,) situated upon the westerly
side of said fountain between Cistus Path and
Spruce Avenue and containing nine hundred and thirty
five and 47/100 feet, more or less.

To have a to hold the same to the said
Mary Hemenway, her heirs and assigns to her and their
own use forever, but only for ornamental purposes,
and subject to the same conditions and restrictions
as are contained in the aforementioned deed.

And the said Proprietors of the Cemetery of Mount
Auburn do hereby covenant to and with the said Mary
Hemenway
her heirs and assigns that they are
lawfully seized of the aforegranted premises and of
