[Text on the top] Nath Cainhin College Resolution 44 H.R. 1082 Session Laws, 1953 A JOINT RESOLUTION PROVIDING FOR THE APPOINTMENT OF A COMMISSION BY THE GOVERNOR FOR THE PURPOSE OF MAKING A STUDY OF ALL INSTITUTIONS OF HIGHER EDUCATION SUPPORTED BY STATE FUNDS

WHEREAS, there has been significant progress during the last decade in the institutions of higher education supported by the State of North Carolina, including the growth of physical plants, the strengthening and expansion of the facilities and staffs and added services to the people of the State; and WHEREAS, the Legislature is aware of these important advances and, in anticipation of the continued growth and development of our institutions to meet the needs of our growing population, it is the sense of the Legislature that a study should be made of the role and function of each of the States Institutions: Now, therefore, be it resolved by the House of Representatives, the Senate concurring: Section 1. The Governor of North Carolina is authorized and empowered to appoint a commission to be known as the Commission on Higher Education and to consist of seven citizens of this State. Section 2. It shall be the duty of the commission so appointed: (1) To make a comprehensive study of the purpose, organization, function and operation of each of the institutions of higher education supported by State funds; and (2) To determine relationships between these institutions and to make recommendations deemed necessary to achieve maximum educational benefits for the people of the State; and (2) To make a study of all the laws of the State pertaining to these Institutions of higher learning and to make recommendations to the 1955 Session of the General Assembly so as to any pertinent revisions of said laws. Section 3. Immediately upon its appointment, the Commission shall meet and elect from its members a chairman and a secretary. Section 4. The Commission may employ, and at pleasure remove, a secretary, counsel, consultants and such other officers and employees as it may deem necessary for the performance of its functions and fix the compensation within the amounts made available by appropriations herein provided.

Continued Resolution 44 H. R. 1082

Section 5. The members of the Commission shall receive necessary traveling expense, per diem and subsistence in accordance with the provisions of the Appropriation Act for the biennium 1953-55. Section 6. The Commission may request and shall receive from any department, division, institution, board, district, bureau, commission or agency of the State or of any political subdivision thereof, such assistance and data as will enable it properly to carry out its powers and duties hereunder. Section 7. The Commission shall make a report of its activities to the Governor from time to time and a full report of its activities and recommendations shall be made to the 1955 Session of the General Assembly. Section 8. The sum of twenty-five thousand dollars ($25,000.00) or as much thereof as may be necessary, is hereby appropriated out of any monies in the State Treasury in the general fund not otherwise appropriated and made available for the use of the Commission hereby created in carrying out the provisions of the Resolution. Section 9. This Resolution shall be in full force and effect from and after its adoption. In the General Assembly read three times and ratified, this the 30th day of April, 1953.

Subject: North Carolina College at Durham Code 1632, Item 8 Power Plant

Dear President Elder:

The matter of the extra for installing a temporary breeching in your heating plant has now been settled and several facts have come to light since Mr. Vick and I met with your Board of Trustees in Durham which lead me to believe that Piping and Equipment Company should be paid in full the amount which they requested for installing and removing the temporary breeching. There were several letters exchanged between the engineers and Piping and Equipment Company and between Piping and Equipment company and the fabricators of the permanent breeching which had not reached our desk and these letters presented the additional facts which are mentioned.

It is recommended that you authorize Mr. Jones to pay Piping and Equipment Company in full the amount of their claim for the extra breeching and without the same amount from the engineering firm on their fee until the matter is finally settled.
