Honor, that he was appointed Trustee to
Said Deed, and accepted the same
under the assurance and belief that it
was a matter of form and never
conceived that it clothed him with
powers and burdened him with
responsibilities, that the said Deed was
not read over to him and that he
signed said Deed and accepted the
Trusteeship, under an entire
misapprehension and mistake of its tenor
and import. And that he believes
and avers that your petitioner , Ellen
E. executed the said Deed under this
mistake and misapprehension .

Your petitioner further shows unto
your Honor, that, if properly advised
and informed of the legal effect of
said Deed, he would not have
executed the same or accepted the Trust
therein. And more particularly as the
Constitution of the State, at the time
secured to a married woman all the
Estate she owned at her marriage or
might acquire during Coverture.

Your petitioners further show unto
your Honor, that by the terms of said Deed
the said George A Smith, is Trustee
