----United States vs Lupton----

---Failure to arrest deserter---

While at dinner at the hotel Bayboro, North Carolina, February 19, 1918 I heard a very heated discussion between Doctor Deess and Sheriff Lupton, and during the remarks Sheriff Lupton took Doctor Dees to task for failure to perform his duty on the Exemption Board. Doctor Dees stated direct to Sheriff Lupton that other officials in the County had not performed their duty and Sheriff Lupton then demanded in what instance he had not performed his duty and Doctor Dees stated that he had failed to arrest or assist in the capture of a deserter that he had seen walking about town that day and any other day the deserter so desired (Doctor Dees gave the name of the deserter but I do not remember it now). Sheriff Lupton replied, in oubstance, "I have not arrested him, nobody else has bothered him and nor none of my deputies will," stating further that he would be d--d if he would bother any deserter unless he held papers for some other offence. The discussion became so heated that I expected a fight in the dining room and left before I finished eating dinner.

2nd Ind. Hq. 90th Infantry, Camp Sevier, S. C. , Nov. 12, 1918. -- To Commanding General, 20th Division. (Through Commanding Officer, 40th Infantry Brigade) Returned.

It is reccomended that if a true bill be found against this man that he be turned over to the civil authorities for trial upon due request made by them.
