North Carolina ss In the name of god Amen I Wm Steward
of the preinct of Pequimons planter tho weak of body yet of
perfect & sound mind & memory praised be god hereby
making null & voyd all former wills by me prior do mak &
ordeine this my last will & Testamt in maner & form following
Imp: I give & bequeath my soul into the hands of god my Creator who
first gave it me my body to the Earth to be buried in a decent Christian Manner
Item: I give bequeath that plantation & tract of land on wch I now live to my daughter
Patience & the heirs of her body after the Discease of Eliza my now Wife & not before
Item: I give & bequeath a plantation & tract of land Commonly Called or known by
the name of frog hall into my daughter Elizabeth & the Heirs of her body to be possessed
there with Imediately after my Discease & allso my will is that if
Either of my two sd Daughters Shall dye without Issue then
the sd land & plantation shall remaine to the surviveor & if it should
happen that both my sd Daughters should dye without Issue then
the sd plantations & tracts of Land Shall Discend to the next
Heire. allso my Will is that my Musket & Iron pestle shall
Remaine on this plantation where I Live for the benefitt
of them that shall live thereon. Item I give to my Daughter
Mary one Shilling: Item I give to my two Sons William
& Joseph One Shilling Each. Item I give unto my Loving
wife Eliz Steward all the Rest of my Estate wtsoever to be
wholy at her Dispose whom I do Constitute my whole & Sole
Executrix of this my Last will & Testamt In Wittnes whereof
I have Set my hand & Seal this 11 of Augst 1709

And before Signeing or Sealeing I declare it to be my Will that my
Wife & Daughter patience & her heirs Liveing on this plantation
Shall have the liberty of geting & fetching Timber for the use of
the sd plantation from the Land of Frog hall without the hindranc
or Deniall of my Daughter Eliz or her heirs and allso my
Daughter Eliz shall have Liberty of building a house upon
the Line of this land for the Convenience of a Spring of Water
without the Hindrance or Denyall of my [crossed out word (Daughter)] ^(Wife) Eliz or
my Daughter Patience or her heirs, my Will allso is that
any Sett of Wedges Shall be for the use of both plantations
allwayes
