The case had been sent to the Society to prosecute and the preliminary steps had been taken, but the grand Jury had failed to indict Mr Babcock.

The result of a post mortem examination made by two Veterinary surgeons proved that the horse had ruptured a blood vessel, caused by over exertion.

Mr. Bergh moved the following resolution

"That the resignations of [Messes?] Babcock &] [Kane?] be accepted and their dues returned to them."

This resolution was opposed and lost; and Mr Ely moved

"That the resignations of the two gentlemen be accepted."

This motion was seconded and carried.
