House Bill No. 378.

STATE OF WASHINGTON, THIRD REGULAR SESSION.

Read first and second time by title February 17th, and referred to Committee on Tide Lands.

AN ACT

To create a Harbor Line Commission and prescribe its duties and the compensation of its members, and declaring an emergency.

Be it enacted by the Legislature of the State of Washington:

SECTION 1. There is hereby created a harbor line commission to consist of five com2 missioners, who shall be disinterested person, citizens of this state, to be appointed by the 3 governor.

SEC. 2. Said commissioners shall hold office until the first day of April, 1895. Should 2 a vacancy or vacancies occur in said board by resignation or otherwise, the same shall be 3 filled by appointment by the governor.

SEC. 3. The duties of the said harbor line commission shall be to locate and establish 2 harbor lines in the navigable waters of all harbors, estuaries, bays and inlets of this state, 3 wherever such harbor lines have not already been located and established by the board of 4 harbor line commissioners heretofore existing in this state, and wherever such navigable 5 waters lie within or in front of the corporate limits of any city, or within one mile thereof 6 upon either side, and to determine the area mentioned in section 1 of article XV of the 7 constitution of the State of Washington, and to revise, modify, change, revoke, relocate, re8 establish and redetermine harbor lines and areas already established or determined by said 9 board of harbor line commissioners, and to perform all other duties provided and prescribed 10 in article XV of the constitution of the State of Washington, and all such other duties as 11 the law may prescribe; and wherever and whenever said harbor line commission shall have 12 established and determined or re-established or redetermined the lines or areas as herein 13 provided in any of the navigable waters of the harbors, estuaries, bays and inlets of this 14 state, it shall file the plat thereof in the office of the secretary of state and a duplicate 15 thereof in the office of the clerk of the city where harbor lines and areas shall have been by 16 it located and determined, or relocated or redetermined, and from and after the filing of said 17 plat the harbor lines and areas established and determined or re-established or redetermined 18 as therein and thereon designed and displayed shall be and the same are declared to be the 19 harbor lines and areas of that portion of the navigable waters of this state: Provided, That

20 no harbor line or area already located or established shall be so revised, modified, changed, 21 revoked, relocated, re-established or redetermined so as to interfere with or impair any 22 private vested right growing out of or consequent upon the previous location, establishment 23 or determination thereof, nor unless said commission shall deem such revision, modification, 24 change, revocation, relocation, re-establishment, or redetermination to be for the commercial 25 interests of the people of this state.

SEC. 4. Said harbor line commission shall also establish and locate a harbor line in the 2 navigable waters of all lakes and rivers of this state wherever such navigable waters lie 3 within or in front of the corporate limits of any city or within one mile thereof on either 4 side, and no right whatever in the waters beyond, that is to say, in front of such a harbor 5 line, shall ever be given, sold, leased or disposed of to any private person, corporation or 6 association.

SEC. 5. As soon as said harbor line commission shall have completed its action with re2 spect to any harbor line or harbor area it shall report the fact to that commission or func3 tionary of the state which at that time shall have management and disposition of the tide 4 lands belonging to this state, and all jurisdiction of said commission over such harbor line 5 or area shall thereupon and thenceforth cease.

SEC. 6. The harbor line commission hereby created shall begin operations as soon as 2 may be practicable, and is hereby authorized to employ a clerk, a competent surveyor and 3 such assistance as may be necessary, and to purchase such material and supplies as may be 4 necessary to carry out the full intent and purpose of this act at such rates as compensation as 5 they may deem advisable. To carry into effect the provisions of this act the sum of ........... 6 thousand dollars, or so much thereof as may be necessary, is hereby appropriated out of the 7 tide land fund in the state treasury not otherwise appropriated.

SEC. 7. Each of said harbor line commissioners shall receive five dollars ($5.00) per 2 day for each and every day employed in the discharge of this work and his actual traveling 4 expenses.

SEC. 8. The harbor line commission shall audit and allow all bills incurred in the dis2 charge of the duties provided for in this act, and upon presentation of the proper vouchers 3 so allowed the state auditor is authorized to draw his warrant on the state treasurer or the 4 several amounts so allowed, and the state treasurer is hereby authorized to pay said war5 rants out of any money in the treasury appropriated for this purpose: Provided, That no 6 expenses shall be incurred for the payment of which no appropriation shall have been made.

SEC. 9. The harbor line commission shall keep an itemized account of all expenses in2 curred, and report the same to the secretary of state.

SEC. 10. All maps, plats, books, records, papers, accounts, implements, furniture and 2 other public property on the fifteenth day of January, 1893, in the possession or under the 3 control of the late board of harbor line commissioners or pertaining to said board shall be 4 forthwith turned over to the harbor line commission hereby created by any person or per5 sons having the same in their possession or under their control, upon its demand therefor. 6 And upon the expiration of the term of office of said harbor line commission said commis-

7 sion shall turn over to that commission or other public functionary then having management 8 and disposition of the tide lands belonging to this state all maps, plats, books, records, pa9 pers, accounts, implements, furniture and other public property then in possession of or 10 under the control of said harbor line commission.

SEC. 11. The commission hereby created shall be deemed to be the successor of the 2 board of harbor line commissioners created by the act of the legislature of the State of 3 Washington entitled "An act to create a board of harbor line commissioners, prescribing 4 their duties and compensation," approved March 28, 1890, and all acts and parts of acts in5 consistent with the provisions of this act are hereby repealed.

SEC. 12. Whereas, at present no harbor lines have been established in front of some of 2 the incorporated cities in this state, and the establishment of such harbor lines speedily is for 3 the welfare of the people, an emergency is hereby declared to exist, and this act shall be4come a law from and after its passage and approval by the governor.
