740 JOURNAL OF THE PROCEEDINGS OF THE On motion Committee on Beach Road given until the next regular meeting of the Council to report On motion theStreet Committee is given further time to report onTerrace Street sidewalk On motion H L Yesler is granted permission to put a sewer in the alley in Block 9 of Maynard's plat to connect with Washington Street sewer. Ordinances An Ordinance is submitted by the City Attorney entitled "An Ordinance to license the business of selling Fruit Trees" which after discussion is on motion referred back to the City Attorney; Councilman Keenen, Post, & Young voting no. An Ordinance is submitted by the Clerk entitled "A special Ordinance appropriating money to pau audited bills" which upon due consideration is passed by the following vote viz: In favor of the same R H Calligan, J Furth, Geo W Hall, W A Harrington, John Keenen, T W Lake, Chas McDonald, J J Post, and G W Young against none. 741 COMMON COUNCIL OF THE CITY OF SEATTLE Feb 5 1886 Petition of Citizens of Houghton et al praying for the establishment of Madison Street and the buildingof a sidewalk thereon. Read and referred to Street committee Petition of D B Jackson praying that the alley running through Block 56 Maynard's Plat be vacated rec'd and read and on motion the petition is granted and the City Attorney directed to submit an ordinance vacating said alley. Petition of Geo G Lyon et al for a sewer along the East side of Seneca Street in front of Block 14 Boren's Addition, to connect with Seneca Street sewer. Referred to Com on Sewers. Petition of Fred Gasch et al praying the Union Street sewer be extended to 8th Street. Referred to Committee on Sewers with instruction to report at the next meeting of the Council. Petition of W V Rinehart for permission to repair and alter wooden buildings corner of 3rd and Mill Streets, under direction of the Chief of the Fire Department. Granted Petition of Andrew Slorah for the modification of Ordinance No 607 so as not to require Breweries doing a strictly wholesale business to take out a City license. Referred to Com on Licenses Petition of F T Johnson et al for opening Clay Street from Front Street to Fourth Street, thence north along [?] St three blocks. Referred to Street Committee Remonstrance of Matthias Baily et al against the abandonment of Leonora Street between the alley and Front Street; read and tabled. Reports Report of City Jailor, City Justice, and J P Geo G Lyon rec'd read and referred to the Committee on Judiciary.

742 JOURNAL OF THE PROCEEDINGS OF THE Report of City Treasurer for month of January read & referred to Finance Committee. Report of custodian of the Powder House read & ordered filed Report of City Attorney for the month of January read & approved and ordered filed Report of Acting chief of the PoliceWm Murphy for month of January read and approved and ordered filed. Quarterly Report of Dr J S M Smart read and referred to Committee on Sewers and Drainage Report of Street Commissioner or month of January referred to Street Committee and returned approved. Report of City Surveyor on Stone Corner Monumants read and referred to Committee on Public Grounds and Buildings. Committee Reports Received From Finance Committee recommending that the sum of $5000.00 be transferred from the City Fund to the Road Fund. Adopted From Street Committee recommending that the Wharf at the foot of Madison Street be leased to the Commercial Mill & Lumber Co. Report adopted and and a lease ordered drawn for the period of two years at a rental of $5.00 per annum the wharf to be kept in good repair by the leasee. From Same Committee recommending that the petition of E H Ingraham et al for the abandonment of Lenora Street be not granted. Report adopted From Comittee on License and Revenue reporting back the petition of R Russell et al praying that the license of vehicles be made payable one year in advance without recommendation. On motion said petition is granted. Councilman T W Lake & John Keenen voting no From Committee on Fire and Water reporting that the new bell for Engine House No 1 has been received and accepted and properly hung in the Belfry. Adopted

743 COMMON COUNCIL OF THE CITY OF SEATTLE Feb 5 1886 From Same committee returning report of the chief of the Fire Department in regard to Engineer James Ingraham with the recommendation that the same be tabled for the reason that there are no charges made against said Ingrahamsave that of ill feeling. adopted From Committee on Beach Road reporting that of the 40 lots across which the proposed road would run the free right of way had been obtained of 33 and negotiations were in progress to secure the right of way across the remaining 7 Report adopted and on motion the City Attorney is directed to draw the necessary ordinance establishing said highway. From Committee on Public Grounds reporting that the soil of the City Park was not in suitable condition for transplanting shrubbery and recommending that the matter be indefinately postponed. adopted From the City Attorney reporting that Geo H Wright is not in in his opinion entitled to the return of his Road Poll tax as asked for, as the said Wright was not connected with the Fire Department at the time the assessment was made and therefore cannot claim his exemption. Adopted Also an verbal report from the City Attorney that in his opinion the ordinance for the licensing of the sale of fruit trees heretofore submitted is invalid.
