Ordered that the Council do now adjourn Approved T T Minor mayor Attest W R Forrest clerk May 18 1888 Be it remembered that on this 18th dayof May A D 1888 the Common Council of the City of Seattle meets in its Council Chamber pursuant to law. The following Officers are present to wit: His Honor the Mayor Thos T Minor and Councilmen Furth, Frink, Green, Lake, Neitsz, Russell & Reitze Absent Moran Whereupon the following proceedings are had to wit: Petitions and Communications Petition of Elizabeth H Shumway for permission to remove earth from Randolph Street read and referred to the Street Committee with power to act. Petition of Mary E Kenworthy and others for an iron stone sewer in Sixth Street from Union Street to Pike Street read and referred to Committee on Sewers and Drainage. Petition of W H Gleason and others for extension of Washington Street sewer to Eleventh Street read and referred to Committee on Sewers and Drainage. Peetition of J J Post and others for grading Fifth Street and building sidewalks on both sides of said street from Seneca Street to Mill Street read and referred to St. Com. Petition of Thomas Emerson and others for grading & building sidewalks on both sides of Tenth Street from Seneca Street toSpring Street read and

471 COMMON COUNCIL OF THE CITY OF SEATTLE May 18 1888 granted the same to be included in the assessment district heretofore created in Tenth Street from Broadway to Spring Street Petition of M McDonald for permission to use the foot of Washington Street near Commercial Street to Commercial Street next to Esmond Saloon Granted. Communication from the Boardof Fire Delegates reporting that Josiah Collins had been duly elected Chief of the Fire Department at an election held pursuant to law on Manday May 7th 1888 read and on motion of J Furth the siad Josiah Collins is appointed chief

Petition of J C Britton and others for opening and extending West Street through to Mill Street read and referred to the Committee onStreets. Petition of Dillis B Ward on behalf of the Methodist Protestant Church for permission to enlarge the M P Church corner of Madisonand Second Streets read and referred to Com on Public Buildings & Grounds. Communication received from the owners of property condemned along the line of Depot Street by ordinance #928 appointing J D Smith to act as appraiser in their behalf, pursuant to notice duly published and it aspering to the Council that the owners of property benefited have not filed notice of appointment of an appraiser to act in their behalf in the matter of the condemnation of property along the line of Depot Street under ordinance No 928, and this being the time set for appointing such appraisers: It is ordered that J D Smith be and he is hereby appointed to act as appraiser on behalf of the owners of property condemned and that Geo Kinnear Esq be and he is hereby appointed an appraiser on behalf of the owners of property benefited by the extension and opening of said Depot Street under said ordinance No 928.Where upon his Honor the Mayor appoints L B Andrews Esq an appraiser to act on behalf of the City insaid matter. 473 COMMON COUNCIL OF THE CITY OF SEATTLE May 18 1888 be tabled. Adopted. From the same Committee granting petition of A A Bell & others from grading and building sidewalks on both sides of Wall Street from Elliott's Bay to Depot Street. and City Surveyor directed to submit plans and specifications from such improvement at the next meeting of the Council. Adopted From the same Committee rejecting petition of E D Briscoe & others for grading Sixth Street from Spring Street to Marion Street as the petition has not been signed by a majority of the property owners, and your committee is that a petition will be presented to the Council for the grading of said Sixth Street from Depot Street to Spring Street. Adopted From the same Committee rejecting petition of A A Bell & others for opening Bell Street from Seventh Street to Depot Street as there does not appear to be any urgent necessity for opening said street at the time. Adopted. From the same Committee to whom was referred theOrdinance asked for by the Seattle Street RailwayCompany, amending the franchise heretofore granted said Company as follows: "We do not think it advisible to grant said Seattle Street Railway Company and other or further priviledges than have already been granted it by the City and therefore recommend that the petition benot granted and that said ordinance be not passed. Adopted. From the same Committee rejecting petition of the West Street-Lake Union and Park Transit Company for a street Railway Franchise. Councilman Reitze of the Committee presents a minority report recommending the granting of the franchise under certain conditions and restriction. 474 JOURNAL OF THE PROCEEDINGS OF THE May 18 1888 conjunction with the City Attorney with instruction to confer with the parties seeding the franchise and report on ordinance at the next meeting of the Council. From the same Committee rejecting petition of W H Wheeler & others for a Street Railway franchise. Adopted. From the City Attorney on the Claim of Providence Hospital as follows: "In the matter of the Claim of Providence Hospital for the support of John Brandon asmitted to the Hospital at the request of the Mayor I beg to report that the claim is not enforcible at law and the City can if it so desires resist the payment of the same": On motion of Councilman Furth the matter is ordered referred to a Special Committee. From the City Attorney on the demand of Dexter Horton & Co for the payment of certain scrips as follows: In the matter of the Communication of Dexter Horton & Co I have the honor to report that I do not consider that the officers of the City have been guilty of such negligence as to render the City liable for the payment of the scrip referred to. I do consider however that none of the scrip issued by the City should ever by repudiated, and that the City should make arrangements [?rooking] to the payment of such scrip as the City cannot make out of the property owners. The property owners in nearly all the cases now pending will at an early date submit a proposition for settlement of such cases, I would like to have the matter of this settlement as well as the Communication referred to myself and the Finance Commttee for adjustment." Adopted and the whole matter referred to the City Attorney and Finance Committee.
