March 6, 1905.

Mrs. Jeannie L. Lawton, 65 West Forty-fifth Street, New York City.

My dear Mrs. Lawton:-

Your telegram of the 5th inst. was not received by me until this morning a little after nine o'clock. It reads as follows:

"Does Aunt's will create trust one million dollars for self, sister, and Gunning children? Where does remainder go on its termination. Please order copy will. Answer paid."

At the same time I received a telegram from the Tribune, reading as follows:

"Was one million dollars placed in trust for two nieces of Mrs. Stanford, namely, Mrs. Lawton and Mrs. Hansen and for Daniel Gunning and Amy Gunning, children of her deceased niece? Who is the trsutee and what becomes of the remainder of the cestui que trusts? Does the will give Mrs. Stanford's brother, Charles G. Lathrop one million dollars? Kindly answer."

To which last telegram I answered as follows:

"San Jose, California, March 6, 1905.

The Tribune, New York City. Mrs. Stanford's will gives one million dollars to Charles Lathrop, absolutely:

One Million to Ariel Lathrop in trust for his life, remainder over to his heirs by blood per stirpes, naming them;

One million to heirs of Daniel Shields Lathrop in trust per stirpes, naming them; remainder over to their respective heirs by blood, naming them;

Gunning children get their share absolutely when twenty-five years of age; if either die before that age, then his or her share to his or her heirs;

Union Trust Company of San Francisco trustee for all trusts.

S.F. Leib."

I also, at the same time, answered your telegram as follows:

"San Jose, California, March 6, 1905. Mrs. Jeannie L. Lawton, 65 West Forty-fifth Street, New York City. See my answer to New York Tribune sent herewith. Will send you copy of will immediately.

S.F. Leib."

I assumed from the tone of both inquiries that they both referred to the same matter, and hence one long answer would serve for both purposes. At any rate, you can easily get a copy of the telegram at the Tribune office.

I send you herewith a copy from the Examiner of the will. I have no doubt of its absolute correctness. Should you wish to compare it, I will send you a certified copy.

The time for proving the will is set for the 24th of this month.

If I can extend any further courtesies to you, I will be very glad to do so.
