I am directed by Senator Stanford to hand you the enclosed papers in relation to the Monahan claim. He wired you today in that connection as follows: "Appeal the Monahan suit. The damage is outrageous."

This Indenture, made the Second day of October eight hundred and seventy six, witnesseth that Leland Stanford party of the first part do hereby lease demise and let unto John Monahan party of the second part, the following described property, in San Mateo County, State of California to wit:

All that tract or parcel of land purchased by the party of the first part from Richard Tobin, and being part of what was known as Lot No 12 Tobin Tract, being bounded on the North by the lands of John Monahan, on the South by the lands of S. M. Meyes, on the east by the Center of the San Francisquito Creek, and on the West by the Santa Cruz County Road

Containing 1 98/100 acres

To hold by the party of the second part from the second day of October 1876, to such time or date as the party of the first part may determine.

Building and paying therefor at the rate of One dollar per annum, and also giving also to the party of the first part permission to build and [bottom line part missing illegible]

required by the party of the first part for the purpose of irrigation or otherwise at any point above the County Road Bridge not however of such a height as to overflow or injure the lands of the said party of the second part.

And to quit and deliver up the premises hereby leased, to the lessor or his superintendant peaceably and quietly when required to do so, in as good order and condition as the same are now.

In witness whereof said parties have hereunto set their hands the day and date above written
