This Agreement made and entered into between Lucy Hassall Executrix, for and on behalf of herself and Executors of the late Samuel Otoo Hassall on one part, and Thomas Peasenell on the other, Witnesseth; that, the said Lucy Hassall doth agree to give to the said Thomas Peasenell quiet and peaceable possession of a piece or parcel of land formerly occupied by William Goodenough, containing Twenty Acres more or less being part of a Farm known by the name of Milford Vale in the District of Bathurst and County of Roxburgh; Bounded on the South and West by the Fish River on the East Mr Henry Cox's grant, and on the  North by the remaining part of Milford Vale, for the full term of Seven Years, from the Fifteenth day of January, in the year of Our Lord One thousand, Eight hundred and Twenty Nine, on the following conditions. That ,Thomas Peasenell shall pay, or cause to be paid, unto Lucy Hassall or any  person duly authorized by her to receive the same the Yearly Rent of Twenty Pounds Sterling, commencing said Fifteenth day of January One thousand Eight hundred, and twenty nine, and that he shall erect or cause to be erected on the said land, a House, with at least Twenty-five Pounds Sterling, and put up a good Substantial Three railed fence, and properly enclose the land, within the term of Five Years from the commencement of this Lease: Provided, Nevertheless; that the said Thomas Peasenell keep a good, and orderly house, and does not trespass, or knowingly allow any person or persons to trespass, on any other part of the Farm during this Agreement.

The said house and fence, together with all other improvements, to be left [indecipherable] Tenantable repair at the end of [indecipherable] Years. And for the due fulfilment of this agreement the parties herein named do bind themselves the one to the other in the penal sum of Fifty Pounds, good and lawful Money. In Witness whereof they have hereunto set their hands and Seals, the days and dates underwritten.

Articles of Agreement indented, had made, concluded, and agreed upon, this Sixteenth day of May, in the Year of our Lord one thousand, eight hundred, and thirty four - Between the Reverend Thomas Hassall of Denbigh, in the district of Cooke, Clerk - James Hassall of Matavai in the district of Cooke. Esquire.William  Shelley of Grampian Hills. in the District of Goulburn :Esquire. and Lucy Hassall (now Lucy Howell widow of the late Samuel Otoo Hassall of Macquarie Grove, in the District of Cooke , and Territory of New South Wales, Esquire: as Executors and Executrix of the late Samuel Otoo  Hassall, of the one part . and Arthur Kemmis of Sydney in the Territory aforesaid.  Esquire, of the other part   Witness , that the said Reverend  Thomas Hassall, James Hassall, William Shelley, and Lucy Hassall (now Lucy Howell) in consideration of the Rent and  Covenants hereinafter reserved and contained on the part of the said Arthur Kemmis, his Executors or Assigns, to be paid, observed and [performed?] Hath covenanted, promised, and agreed and by the presents doth covenant promise and agree to and with the said Arthur Kemmis to let unto the said Arthur Kemmis in consideration  of the premises Hath on his part covenanted promised and agreed, and by these presents Doth covenant, promise and agree to and with the  said Reverend Thomas Hassall, James Hassall, William Shelley and Lucy Hassall (now Lucy Howell) their Executors Administrators or assigns to take and [hire?] all that Farm and Dwelling Houses thereon erected situate standing and being in the district of Bathurst and County of Rexburgh; known by the name of Milford Vale containing 800 acres be the same more or less Bounded on the South and West by the Fish Rive, on the East by Mr [Kessy?] Cox's grant and on the North by a Government Reserve and all and singular the outbuildings and Garden thereto belonging for the Term of Seven whole years certain from the First day of January in this present year of our Lord one thousand, eight hundred and thirty four upon the terms or conditions following, that is to say The said Arthur Kemmis doth hereby for himself his Executors Administrators and Assigns covenant, promise, and agree to and with the said Reverend Thomas Hassall, James Hassall, William Shelley and Lucy Hassall (now Lucy Howell) for themselves, Executors, Administrators and Assigns in manner following, that is to say That the said Arthur Kemmis Executors Administrators or Assigns shall and will well and truly pay unto the said Reverend Thomas Hassall, James Hassall, William Shelley and Lucy Hassall (now Lucy Howell) their Executors Administrators or Assigns the yearly Rent or Sum of Five Pounds good and lawful money of Great Britain (to be paid by Half yearly instalments) from the day of the commencement of the said Tenancy - and that the said Arthur Kemmis, his Executors, Administrators or

or assigns shall and will keep the dwelling house in good and tenantable repair at his or their own cost or charge. And that he the said Arthur Kemmis his Executors, Administrators or Assigns shall and will keep the outbuildings, railings, fences and every part of the said premises in good and tenantable repair during the whole time of said tenancy and furthermore the said Arthur Kemmis, his Executors, Administrators, or assigns, shall, and will build at his, or their own cost and charge, at least Five good and tenantable rooms in addition to the present Dwelling House - as also a Laundry, Forge, and sundry out offices, and other accommodations and improvements, and furthermore, the said Arthur Kemmis For himself, his Executors, Administrators or Assigns, will and shall put up, and keep in good repair, good substantial three rail fences, round all land which shall [befit?] under cultivation on said farm, in addition to what is already  under cultivation, and furthermore, the said Arthur Kemmis for himself, his Executors, Administrators and Assigns, shall and will cause all stumps of trees to be removed out of such land as shall be put under cultivation, in addition to what is already under cultivation on said farm - and shall and will quit and deliver up the same and every part and parcel thereof in good plight and condition, and further that the said Arthur Kemmis, his Executors, Administrators or Assigns, shall not, or will not, take or pull down or cause to be taken, pulled down or detroyed, any part of the said Dwelling House, Outbuildings, railings or fences, or any other part of the said premises, without the licence or consent of the said Reverend Thomas Hassall, James Hassall, William Shelley, and Lucy Hassall (now Lucy Howell) their Executors, Administrators or Assigns or their Constituents or Agents for the time being, in writing for that purpose first had and obtained. And the said Reverend Thomas Hassall, James Hassall, William Shelley and Lucy Hassall (now Lucy Howell) do hereby for themselves their Executors, Administrators, and Assigns, covenant promise and agree to and with the said Arthur Kemmis, his Executors, Administrators and Assigns, that they the said Reverend Thomas Hassall, James Hassall, William Shelley and Lucy Hassall (now Lucy Howell) do by those present give and deliver over possession of the said premises on the said First day of January, in this present year of our Lord, one thousand, eigth hundrem and thirty four, on which day the said Tenancy is to commence - And that the said Arthur Kemmis, his Executors, Administrators or Assigns shall from thence-forth have, and retain peaceable and quiet possession of the said premises

premises, free from the lot, suit, or trouble, molestation, or hindrance, of or by them the said Reverend Thomas Hassall, James Hassall, William Shelley or her the said Lucy Hassall (now Lucy Howell), their Executors, Administrators or Assigns, or of from or by, any other person or persons, claiming, or to claim from, by, or under these, or any of or of from or by any other person or persons, whomsoever or wheresoever; until the end of thesaid tenancy. And it is hereby lastly mutually covenanted and agreed between the said parties that in case either of them, their Executors, Administrators or Assigns, shall be minded or desirous after the expiration of the said Tenancy to put an end to and determine the same, they shall be at liberty to do so when giving unto the other of them their Executors, Administrators or Assigns, Six Calendar Months notice or warning of such their, his or her mind and intention; and that from and immediately after the expiration of the said Six Calendar Months notice or warning in writing; this present Indenture and every covenant clause, article, and agreement herein con-tained, and the tenancy hereby created shall from thenceforth cease, end, and determine save and except the covenant as to the payment of any Rent that may then remain due and unpaid. And for the due performance of these present, each and every of the said parties hereto do bind themselves, their Executors, Administrators, and Assigns in the Penal sum of One Hundred Pounds. - In Witness whereof, the said parties have hereunto set their hands, and affixed their seals, the day, and year First hereinbefore mentioned-

or Administrators Provided also and it is hereby declared and agreed by and between all the said parties to these Presents that the said John Campbell and Robert Campbell the Younger and such Trustees or Trustee as aforesaid their Executors Administrators and Assigns shall each of them be charged and chargeable only for such monies as they shall respectively actually receive by virtue of these Presents and that the one of them shall not be answerable or accountable for the other or others of them or for the Acts Deeds Neglects receipts or defaults of the other of them but each of them for his own acts Deeds neglects receipts or defaults only AND also that it shall and may be lawful for the said trustees and the survivor of them his Heirs Executors and Administrators in the first place by and out of the trust monies to deduct and reimburse themselves respectively AND also to allow to each other all such losses costs charges and expenses as they any or either of them may at any time or times pay sustain expend or be put unto for or by reason of the trusts hereby in them reposed or in the management or execution thereof notwithstanding their or either of them acting professionally in relation thereto.  AND the said John Campbell and Robert Campbell the Younger
