[AL83] This Indenture made the 26th day of Septr in the Year of Our Lord one thousand eight hundred and thirty eight Between His Excellency Sir George Gipps Knight Captain General and Governor in Chief of the Territory of New South Wales and its Dependencies and Vice Admiral of the same of the first Part. The Reverend Thomas Hassall of Denbigh in the said Colony Clerk one of Her Majesty's Chaplains of the said Colony of the second Part And John Campbell of Campbells wharf Sydney in the said Colony Esquire and Robert Campbell the Younger of George Street Sydney aforesaid Esquire of the third part. Whereas by certain Regulations made in consideration of the inadequacy of the Salaries of the Chaplains in New South Wales it was proposed and arranged by His late Majesty's Government that the Children of each of the Chaplains of New South Wales should be entitled to receive certain Grants of Land on their respectively arriving at the ages hereinafter mentioned that is to say the Sons of such Chaplains to one thousand nine hundred and twenty acres at the age of nineteen years And the Daughters of such Chaplains to one thousand two hundred and eighty acres at the age of eighteen Years to serve as a future provision for such Children  And whereas subsequent to such regulations the system of granting Lands became abolished and that arrangement was

was superseded AND it was finally arranged on behalf of His late, Majesty's Government that instead of the Land a sum of money equal to the value thereof fixed at a determined rate should be, vested in the hands of Trustees to form a Fund for the benefit of the Family of the said Chaplains, x AND WHEREAS under the said Regulations the several Sons hereinafter mentioned of the said, Thomas Hassall would on their respectively attaining the age of nineteen years have become entitled respectively to a Grant of one thousand nine hundred and twenty acres, and his several Daughters hereinafter named would on their respectively attaining the age of eighteen years have become entitled respectively to a Grant of one thousand two hundred and eighty acres of land,  AND WHEREAS in consideration of the Premises His Excellency Sir Richard Bourke late Governor of the said Colony, with the advice and consent of the Legislative Council thereof by an Act of the said Council passed on the fourth day of August one thousand eight hundred and thirty seven Entitled "An Act for applying certain Sums arising from the Revenue receivable in New South Wales to the service thereof for the Year one thousand eight hundred and thirty eight and for further appropriating the said Revenue" was pleased to grant in lieu of the said land and in Commutation of the claims thereto of the several Children of the said Thomas Hassall, hereinafter named, the

several Sums hereinafter mentioned to be placed in the hands of Trustees  x Upon the Trusts hereinafter declared that is to say the sum of two hundred and eighty four pounds fourteen shillings and eight pence halfpenny in the compensation for the claim of James Samuel Hassall of the age of fourteen years or thereabouts, the sum of one hundred and ninety pounds eight shillings in compensation for the claim of Catherine Elizabeth Hassall of the age of thirteen years or thereabouts the sum of one hundred and sixty pounds, six shillings and three farthings in compensation for the claim of Mary Ann Hassall of the age of eleven years or thereabouts the sum of one hundred and eighty four pounds one shilling and one penny farthing in compensation for the claim of George Thomas Hassall of the age of nine years or thereabouts the sum of one hundred and ten pounds five shillings and a farthing in compensation for the claim of Harriet Jane Hassall of the age of seven  years or thereabouts, the sum of one hundred and twenty two pounds and ten pence farthing in compensation for the claim of Charles Rowland Hassall of the age of five years or thereabouts and the sum of sixty seven pounds nine shillings and eight pence farthing in compensation for the claim of Eliza Marsden Hassall of the age of three years or thereabouts, which said James Samuel, Catherine

Elizabeth, Mary Anne, George Thomas, Harriett Jane, Charles Rowland, and Eliza Marsden are the lawful children of the said Thomas Hassall Non this Indenture. Witnesseth that in pursuance of the said Act of the said Governor and Council and in consideration of the Premises His Excellency the said Sir George Gipps with the consent of the said Thomas Hassall testified by his executing these Presents Hath given granted transferred and assigned And by these Presents Doth give grant transfer and assign Unto the said John Campbell and Robert Campbell, the Younger the sum of one thousand one hundred and nineteen Pounds five shillings and five pence farthing lawful money of Great Britain now in the hands of Her Majesty's Government in the said Colony being the aggregate amount of the respective sums so noted in compensation for the Grants of Land as before recited To Hold the same to the said, John Campbell and Robert Campbell and the survivor of them, his Executors Administrations and Assigns In Trust that they the said John Campbell and Robert Campbell and the survivor of these his Executors Administrators and Assigns shall and do as soon as may be after the

[new page] execution hereof lay out and invest the said sum of one thousand one hundred and nineteen pounds five shillings and five pence farthing Upon such Real security at the usual and fair rate of Interest as to them shall seem most advantageous and shall receive and take the Interest thereof and all accumulations thereof, and from time to time call in the said monies And in the like manner reinvest the same and the Interest and accumulations thereof from time to time at Interest as before mentioned subject nevertheless to the Trusts hereinafter mentioned And upon trust that the said trustees and trustee do and shall stand possessed of and interested in the said principal sum in the proportions hereinbe fore mentioned In trust when and as the said James Samuel, George Thomas and Charles Rowland Hassall shall respectively attain the age of nineteen years to pay to each of them respectively or to his assigns the proportion voted to him of the said principal sum as hereinbefore mentioned together with his proportion of the Interest and Accumulations thereof And in trust when and as the said Catherine Elizabeth, Mary Anne, Harriett Jane, and Eliza Marsden Hassall shall respectively either marry or attain the age of eighteen years to pay to each of them or her Assigns the proportion voted to her of the said principal sum as hereinbefore mentioned together with her proportion of the Interest and accumulations
