State of Tennessee Supreme Court at Knoxville September Term 1848
To His Excellency Neill S. Brown, Governor
The undersigned, Judges of the Supreme Court of Tennessee now in session at Knoxville, do hereby certify that Hon: Wm B. Turley one of the Judges of this Court is incompetent to preside on the trial of the suit Philip S. Hale, Plaintiff in error against Michael Darter's Lessee, now pending in said Court at Knoxville, on account of his relation= ship to the Plaintiff in error. We therefore request the appointment of a Special Judge to preside on the trial of said suit.
