By the last mail I sent a request by the Sup. Court for the appointment of a special judge etc. The defendent parties fearful that you might appoint some one who is incompetent to try cause, have requested sue to & say that, Mr Trotter, Mr. McClellan & Mr (?), are engage in the cause; & that Milton Brown is the partner of Mr. Trotter, & Mr. Bullock is the partner of Mr. (?) - & all on therefore in con petent.

I would suggest, on my own responsibility the appointment of Genrl. Gibbs.
