Sir.
From communications made to
us on which we can rely, we feel of a duty
to solicit the pardon of Col. Barnes was
imprisoned under the affermance [sic] of a Judg
ment of the Circuit court - Col Barnes
no doubt committed an error - and in strict
law the correction may be Justified - But
thinking as we do that the impresanment [sic]
was more severe than example required
under the circumstances - we ask clemen
cy on his behalf - The record before
us did not Justify our interferance [sic] with
new trial, did not give a sufficient
reason why Barnes did not have his mishaps
stated in these affidavits be true - He
was present at the seat to prevent and not
to excite mischief -
