rendered a judgment in Allens case I forward
a copy of the Record to gether with a letter
from Judge Powell to the Govr by mail
but whether he ever recd it, or not I do
not know, as I never recd any communication
from his Excellency on the subject, tho
I long looked for one- I can come to
no other conclusion on the subject then
this, that Gov Carroll never acted on
the Case- I haue only to add, that
I was one of Danl Allens Counsel and
I thought then, and think yet, that
Danl Allen ought not to haue been
convicted of Manslaughter. I do believe
that at the time Allen fired the Gun
he was placed in a situation from
which he could not haue retreated
without manifast danger to his life
or the life of his brother. And of this I
think any person will be satisfied who
will read the statement of the Case, which
is now in the Secretarys Office - It is in
the nature of Mercy to bless the giver, as well
