He is an old man, but not so much advanced in years, as
that it would savour of cruelty for him to undergo pu=
nishment.

After conviction, a motion was made to arrest the judgment,
which failed. And appeal was then taken to the Supreme
court, and the prisoner let out on bail.

In order to prevent imposition, I would suggest, that large
contingent fees are given, to screen the defendant from pu
nishment; which cannot be accomplished by ordinary le
gal means, and the object is to do it at any rate. -
