Dear Sir

I come last evening to this place
and had the good fortune to
meet with Judge Emmerson

We conferred on the subject
of your letter to me, He inclines
and I think will accept
the appointment temporarily
which we all wish him to
accept. It is understood in
the upper Circuit that Powell
would accept the office of
Circuit Judge, in place
of Judge Emmerson.
Emmerson starts back
today, he will see Powell
on his return, until which
period he will not give
you definite answer I think
we may be assured there
