Nashville Novr 10th 1818

Dr Sir,

Judgment was this day passed against
Tyre D. Green for horsestealing. The age of the
defendant is between fourteen and fifteen years.
It was a clear case of guilt, but such was the con-
duct of the procecutor and another witness in behalf of
the state towards the defendant, previous to the com-
mission of the offence, as greatly to [?] the act
done. I have no doubt of the prosecution's being
brought forward from malicious motives, although
I do not suspect the veracity of any witness who
gave testimony. From a consideration of these circum-
stances, combined with the tender age of the defen-
dant, I think the ends of public justice would be
as well answered by the interposition of your power
of pardon, as by a rigorous enforcement of the law.
If you had the power of commuting the punishment,
I would recommend the substitution of a milder
one than that prescribed by the act of assembly, but as
you have not that power, I should be gratified that
