The State of Alabama The Grand Jurors for the said Marshall County State upon their Oath present

that Jesse Allen Daniel S Dickerson Arthur Macfa

-rlane and Alexander Macfarland late of said Cou

-nty on the twenty eight day of March in the year

of our Lord eighteen hundred and thirty eight in

the County aforesaid in and upon the body of one

Graves W Steele feloniously willfully and of their

malice aforethought did make an assault and

that the said Jesse Allen Daniel S Dickerson

Arthur Mcfarland and Alexander Macfarlane

certain guns and pistols there and there charged

with gun powder and sundry leaden shot and

balls which said guns and pistols they the said

Jesse Allen, Daniel S Dickerson, Arthur Macfar-

-lane and Alexander Macfarlane in their hands

then and there had and held, then and there

feloniously, willfully and of their Malice afo-

-rethought did discharge and shoot off to against

and upon the said Graves W Steele and that the

said Jesse Allen, Daniel S Dickerson, Arthur

Macfarlane and Alexander Macfarlane with

the leaden shot and balls aforesaid out of the

guns and pistols aforesaid then and there by

force of the gun powder aforesaid by the said

Jesse Allen, Daniel S Dickerson, Arthur Macf

-arlane and Alexander Macfarlane, discharged

and shot off as aforesaid then and there feloniously willfully and of their Malice aforethought did strike penetrate and wound the said Graves W Steele in and upon the right temple of the head of him the said Graves W Steele, giving to him the said Graves W Steele then and there with the leaden shot and balls aforesaid so as aforesaid discharged and shot out of the gun and pistols aforesaid by the said Jesse Allen Daniel S Dickerson, Arthur Macfarlane and Alexander Macfarlane in and upon the right temple of the head of him the said Graves W Steele one mortal wound of the depth of three inches and the breadth of hlaf an inch, of which said mortal wound he the said Graves W Steele then and there instantly died. And so the Jurors aforesaid upon their oath aforesaid do say that the said Jesse Allen, Daniel S Dickerson, Arthur Macfarlane and Alexander MacFarlane [him?] the said Graves W Steele in the manner and by the means aforesaid feloniously willfully and of their malice aforethought did kill and murder Contrary to the Statute in such cases made and provided and against the peace and dignity of the State of Alabama

State of Alabama-- I Geo W. Lane Judge

of the Fifth Judicial Circuit of the State of

Alabama which embraces the county of Marshall

and sole presiding Judge of the Circuit Court of

said County do certify that John O Feemster

whose name is affixed to the foregoing certificate

is and was at the date of said certificate

the Clerk of said Circuit Court of said

County and thta his certificate is in due form

of law-- Given under my hand this first

day of January 1839-- Geo W. Lane 5th J.C. S. Alabama
